When you are faced with being named as a Defendant in a John Doe torrent lawsuit, and you did not commit the infringement, one of the key things to consider and discuss with your Torrent Defense Attorney is whether or not to file a "declaratory judgement" counterclaim. This can be based on seeking a declaratory of non-infringement to (a) clear your good name, and (b) put the defendant to seek attorney fees under the United States Copyright law as the "prevailing party" in litigation. This is to prevent a Plaintiff who learns they sued the wrong party (IP address does not always identify the actual infringer), from "cutting and running" and leaving the Defendant with no remedy once the Defendant shows their innocence enough to make Plaintiff want to dismiss their lawsuit.
