In this video, Attorney Steve®, California Civil Litigation Attorney, discusses the civil tort concept of “Res Ipsa Loquitur.” This is an evidentiary concept that means “the thing speaks for itself” and is used in Negligence cases to avoid a directed verdict or dismissal of the case. It creates a rebuttable presumption or inference of negligence that shifts the burden of proof to the other side (Plaintiff) where:

1. Defendant was in exclusive control of the instrumentalities that caused the injury

2. The incident is the type that is not likely to occur without negligence.
