"Whitewashing" over graffiti art brings $6.75 million dollar judgment

In this episode of Litigation Whiteboard® Attorney Steve® discusses the Visual Artist RIghts Act ("VARA") and how a property owner in Queens New York was just hit with a 6.75 million dollar judgment for tearing down a building that contained graffiti art ('street art") from 21 "aerosol artsists." The New York federal court ruled that the property owner improperly "whitewashed" the graffiti out of spite and out of revenge for the artists filing a lawsuit and seeking a temporary restraining order ("TRO). This highlights the importance to real estate developers to try to identify the artists and give them a chance to preserve or remove their art before tearing it down. The court found the whitewashing to be "willful" and awarded the maximum amount of damages ($150,000 per work).
