WHAT IS A CIVIL CONTEMPT PROCEEDING?

In this episode of Litigation Whiteboard® Attorney Steve® discusses civil contempt proceedings. These can involve cases where an attorney or a party to a civil court lawsuit (state or federal) or a third party subject to an Order willfully disobeys the order when they have notice (knowledge) of the Order, and an ability to comply. These are considered "quasi-criminal" proceedings because they can involve jail time (check your state statutes for more information). If another party brings a motion, you could also be looking at paying their costs and attorney fees. Check CCP 1209 in California.
