The Weaponization of the ICWPA to Impeach President Donald J. Trump

In August and September 2019, the Office of the Inspector General for the Intelligence Community (ICIG) and Congressional Democrats, weaponized the Intelligence Community Whistleblower Protection Act (ICWPA) process to target President Trump for impeachment. Democratic House Permanent Select Committee for Intelligence (HPSCI) leader Rep Adam Shiff, led the charge, using the ICIG and Inspector General Michael Atkinson to process a disclosure by the so-called "Ukraine whistleblower."

According to the Department of Justice Office of legal Counsel, the disclosure did not meet the letter of the law. Failing on the two crucial parts. First, it was not about an intelligence activity. And second, it did not fall under the authorities of the ICIG and the Office of the Director of National Intelligence (DNI). A serious failure to proceed with such disclosure. By going forward with it, they, Rep Shiff and IG Atkinson, violated the law.

Meanwhile, because the disclosure was secondhand information, by its own policies and procedures, the ICIG could not process the disclosure. So in order to process it, they changed the procedures right at the time of the disclosure. Meanwhile, real IC whistleblowers with first-hand information never had the ICIG process their ICWPA disclosures. And the ICIG failed to provide whistleblower protections to IC whistleblowers alleging reprisals.
