How Will Trump Impact the E-2 Visa?

Love him or hate him Donald Trump is here to stay as the next US president. We have had a lot of our international clients asking us how the new administration will impact their applications for investor E-2 or EB-5 visas.

For those who don't know about the E type visas they allow residents of 80 treaty countries around the world to reside in the USA through business nvestment. E-2 is a lower amount and EB-5 is around 1 million dollars.

The truth is nobody really knows how Trump will work with these visas so we will have to make educated guesses based on what we know. Firstly we know ultimately Trump wants what is best for the U.S economy. If something is creating a positive economic impact Trump likely wont want to change it. And there are many instances of E-2 and EB-5 successes that brought positive economic benefits into US communities.

So based on that alone E-2 EB-5 would probably be safe.

The problem and the wild card here is that Trump is also anti-immigration. If there is any way Trump can get something done with US citizens over those from another country he will try and do it.

That said with E-2 and EB-5 you have 2 major economic benefits - firstly money from another country coming in to the USA, and secondly US workers being hired by these companies that are being opened under the E-2 EB-5 visas.

Now what we expect to happen - and this is complete speculation on our part, is that Trump will continue the programs however with more checks and balances in place. He might increase the investment amounts, increase qualifying criteria, longer wait times and other changes that make it a bit tougher to get into the USA via the E-2.

Another question we get is whether existing E-2 EB-5 visa holders will be asked to leave the country. Very unlikely but we are entering uncharted territory here. WWIII also seems very unlikely but these are very volitile times so we will never say never. And truthfully if times get that bad obtaining a visa is probably not going to be at the top of your list of concerns.
