Montgomery vs Daly, is also known as the famous Credit River Decision. Eventually, the case was appealed, on the grounds that the (state) judge was lacking (federal) jurisdiction. The appeal was denied because they used “unconstitutional ” federal reserve notes in the application. One would think that this would become a story which should have been broadcast worldwide, However, it was quelched.

The story, being silenced, eventually got lost in the public view and Jerome Daly, who was an attorney and represented himself in the case, lost his BAR card. Also, Judge Mahoney, was murdered only a few months later, although the story on his death claims accidental circumstances, or something like that.

If memory serves me correctly they both wound up dead. The attorney that won his suit against the bank, and the magistrate that signed off on it.

Daly based his defense on the argument that the bank had not actually loaned him any money but had simply created credit on its books. Daly argued that the bank had thus not given him anything of value and was not entitled to the property that secured the loan. The jury and the justice of the peace, Martin V. Mahoney, agreed with this argument. The jury returned a verdict for the defendant, and the justice of the peace declared that the mortgage was “null and void” and that the bank was not entitled to possession of the property. The justice admitted in his order that his decision might run counter to provisions in the Minnesota Constitution and some Minnesota statutes, but contended that such provisions were repugnant to the Constitution of the United States and the Bill of Rights in the Minnesota Constitution.

Jerome Daly had a mortgage with the First National Bank of Montgomery, Minnesota. In the Spring of 1967, he was $476.00 in arrears, the bank foreclosed and bought the property at a Sheriff’s sale on June 26, 1967. The bank sued for possession and in a jury trial, presided over by Martin V. Mahoney, Justice of the Peace, Credit River Township, Scott County, Minnesota, was held on December 7, 1968.

First national bank of Montgomery vs. Daly (1969) was a courtroom drama worthy of a movie script. Defendant Jerome Daly opposed the bank’s foreclosure on his $14,000 home mortgage loan on the ground that there was no consideration for the loan. Daly, an attorney representing himself, argued that the bank had put up no real money for his loan. Associate Justice Bill Drexler recorded the courtroom proceedings; he said his role was to keep order in the courtroom.

Drexler had not given much mental acceptance for defense and watching this The Bank President Mr. Morgan took a stand and admitted that the banks routinely created money for loans and that this was standard banking practice. In his court memorandum, Justice Mahoney stated: “Plaintiff admitted that it, in combination with the Federal Reserve Bank of Minneapolis. did create the entire $14,000.00 in money and credit upon its own books by bookkeeping entry. That this was the consideration used to support the Note dated May 8, 1964 and the Mortgage of the same date. The money and credit first came into existence when they created it. Mr. Morgan admitted that no United States Law or Statute existed which gave him the right to do this. A lawful consideration must exist and be tendered to support the Note.”

The defendant won this case and he kept his house. To Daly, the implications were enormous. If it was true that bankers were extending the credits without consideration. It was great defeat for them, as their loans could be declared void in the decision.”

The immediate effect of the decision was that Daly did not have to repay the mortgage or relinquish the property. However, the bank appealed the next day, and the decision was ultimately nullified on the grounds that a justice of the peace did not have the power to make such a ruling.

This nullified case and its reasoning have nevertheless been cited by groups opposing the Federal Reserve System and, in particular, the practice of fractional-reserve banking. Such groups argue the case demonstrates that the Federal Reserve System is unconstitutional.

Because the Credit River decision was nullified, the case has no value as precedent. A U.S. District Court decision in Utah in 2008 mentioned half a dozen such citations, noting that similar arguments have “repeatedly been dismissed by the courts as baseless” and that “courts around the country have repeatedly dismissed efforts to void loans based on similar assertions.

Daly, later was convicted of conspiracy to defraud the United States under 18 U.S.C. section 371, fifteen counts of willfully aiding and assisting in the preparation of false individual income tax returns under Internal Revenue Code section 7206(2), and one count of aiding and abetting the making of a false statement to the United States government under 18 U.S.C. sections 2 and 1001, in connection with a tax scheme involving the “Basic Bible Church of America.
