Clacton Tesco assault saw 'defensive' father break casualty's nose

A "Defensive" father rankled by an assault on his child "lay on pause"

for a street pharmacist outside a shop prior to breaking his nose with a knuckleduster, a court heard.

The "red fog" slipped on Ben Horst, 38, after he met his casualty outside a Tesco store in Clacton to buy weed from him.

Unintentionally, the vendor was the sibling of a man Horst had faced over the treatment of his child.

At Chelmsford Crown Court, Recorder Angela Ice said:

"The vendor you met on that event was the sibling of the singular you'd had a squabble with in regards to your child and his sweetheart.

The court heard the assault was "retribution, to some extent" for an assault on Horst's child.

The casualty experienced a messed up nose, expanding around his eye and a gashed spleen

, burning through five days in medical clinic.

Yet, Ms Ice acknowledged Horst, notwithstanding past convictions for brutality, had

"kept himself on an honest way of living" for about decade.

She said the assault was persuaded by safeguarding his loved ones.

"You've laid down a good foundation for yourself as a family man, obviously a man who safeguards his family," she said.

"On this event [you] safeguarded [your] family at tremendous expense, not exclusively to the person in question, yet to your family and yourself."

She said Horst had shown regret and had shown "progress and devotion" while in jail anticipating sentence.."
