Why Are New York's Red Flag Laws Unconstitutional?

Washington Gun Law President, William Kirk, discusses the recent ruling from the New York State Supreme Court in the matter of G.W. v. N.C. where the court determined that New York's Red Flag Laws, specifically CPLR Sec. 63-a are unconstitutional. But before we all start celebrating the reach of this ruling we have to understand the grounds upon which it was decided. While the ruling itself may have not have immediate impacts for those outside of New York, the long term effectiveness of this argument must be examined and used more often.
