PA Mask Lawsuit, which impacts everyone:
“In September of 2021, Tom Wolf and the Secretary of Health issued a mask mandate for schools in Pennsylvania. Knowing that this was illegal, we filed a lawsuit in the Commonwealth Court. In November of 2021, the court agreed, and declared the mandate void and illegal. Wolf appealed, and the ruling was upheld by the Pennsylvania  Supreme Court in December of 2021. The next day, the Secretary of Education, Noe Ortega, sent an email to every school district in the state telling them that they have the power themselves to mandate masks. Most school districts did not enforce masks, but some did. So we sued the Department of Education, the Secretary of Education, and several school districts again. We are stating that these school boards do not have the authority to enforce masks. The Secretary of Education has since resigned. In November of 2022, the Commonwealth Court ruled that our current case is moot because “No schools are currently enforcing masking”. The court did not address the whole point of the lawsuit, which is that these school boards do not have the authority to enforce masks. Predictably, less than two weeks later, Philadelphia School District is now mandating masks beginning on January 2nd. More school districts will most likely follow. We are filing an appeal, and anything to help with our legal fees will be greatly appreciated.
