Injured Bikers cannot tell the jury in a motorcycle accident case that the wrongdoer has insurance, how much insurance, and what type of insurance! Florida legislators have agreed that juries are not allowed to know about any insurance coverage protecting the defendant. (FL Stat. 627.4136 - Florida’s Nonjoinder Statute).

Your lawsuit must be filed against the at-fault driver, and that driver’s insurance company cannot be named as a defendant. Therefore, throughout the trial, your attorney will verbally and in front of the jury be suing the person who caused your injuries, not the insurance company.

With no mention of insurance, it may seem to the jury that the defendant is personally liable for damages, and that your personal injury case is between you and the defendant – not an insurance company.
