On October 9, 2022, at approximately 6:47 PM, I was patrolling southbound on United States Highway 167 near Timber Ridge Lane. I observed a black Chevrolet Tahoe approaching me, traveling northbound at a speed I believed to be above the posted speed limit. I confirmed the speed to be 74 MPH in a posted 60 MPH speed zone. I proceeded to turn around to perform a traffic stop on the vehicle. As I was catching up, the vehicle turned into a driveway at 5215 Calion Highway. I activated my blue lights as the vehicle was coming to a stop in the driveway. The vehicle then began to drive away slowly, traveling through the grassy yard, around the house, and into another driveway. The vehicle stopped momentarily at the end of the driveway before proceeding northbound on Highway 167. After traveling a short distance, I activated my siren and advised dispatch that I was in pursuit of the vehicle.
The vehicle traveled northbound for approximately five miles at speeds around 75 MPH. I obtained a license plate number, driver description and saw minor children in the vehicle. The vehicle continued northbound, nearing the Calhoun County line and the Ouachita River Bridge. As the vehicle began to cross the bridge, it began to slow to speeds near 40 MPH, and it failed to maintain its lane. Once across the bridge, the vehicle made a U-Turn in the area of Calhoun County Road 244 and began to travel back towards Calion. As the vehicle crested the bridge, it began to slow and pull to the shoulder as if to stop. I then observed what appeared to be a large clear bag, with what appeared to be marijuana, thrown from the vehicle's passenger side window into the river. The vehicle then pulled back onto the roadway and continued southbound. As the vehicle approached the Calion City Limits, it began to make a left turn onto Thomas Street. As the vehicle slowed and began to turn, I attempted to perform a Precision Immobilization Technique, but it was unsuccessful in ending the pursuit. After a short distance, the vehicle stopped at the intersection of Thomas Street and Round Top Street. The driver quickly exited the vehicle and was taken into custody without incident. The driver was later identified as Demarkio Marbray.
After securing Marbray, I checked the welfare of the 4 minors in the vehicle. After removing the minors from the vehicle, I began a search of the vehicle. During the search, I located a marijuana cigarette in the driver's side floorboard and a large stack of money (held together by a rubber band) in the front passenger seat. I also located several opened bags containing marijuana residue throughout the vehicle. Loose marijuana was also observed in the seats and floorboards throughout the vehicle. The minors were turned over to their guardians at the scene. I also made contact with the Child Abuse Hotline regarding this incident. As a result, the Child Abuse Hotline issued referral #2170976.
I transported Marbray to the Union County Detention Center. I contacted Deputy Prosecutor Wynne, and explained the circumstances of this incident. Deputy Prosecutor Wynne advised me to confiscate the money from the vehicle and his person. I completed an ASP Asset Seizure Form, but Marbray refused to sign it. The seized money was counted, and the total amount was confirmed to be $4,353.40. The money was transferred to the ASP Money Forfeiture Account in Little Rock.
Mr. Marbray was charged with the following: Possession of a Controlled Substance (Marijuana) with Purpose to Deliver, Fleeing in a Motor Vehicle, Tampering with Physical Evidence, Endangering the Welfare of a Minor (x4), Speeding and No Driver’s License.
