Judge Laurence Silberman dead | Wrote HELLER overturning DC gun ban | Second Amendment leader

Judge Laurence Silberman of the U.S. Court of Appeals for D.C. has died. He was the reason the Supreme Court heard the landmark Heller decision. Silberman ruled in the Parker decision that DC's total ban on gun ownership infringed on the Second Amendment.

He famously wrote that "The Second Amendment protects an Individual right to keep and bear arms." He wrote that the Founding Fathers did not mean just the militia when it put the 2nd Amendment in the Bill of Rights.

He will likely be replaced by a Pres Biden appointee. But now that the Supreme Court has ruled in Bruen case that all gun control laws have to have an analogous law at the time of the founding of the country and upheld Heller, cases at the appeals courts levels are challenged to push back against SCOTUS.

Judge Silberman was appointed by Pres. Ronald Reagan as a United States Circuit Judge in October 1985, and took senior status on November 1, 2000. He received the Presidential Medal of Freedom on June 19, 2008.
