Man Revving His Sportscar is Arrested for OWI After Breathalyzer Refusal

ELKHART LAKE, WI - At 12:33AM on June 7th, 2020, Elkhart Lake Police observed a man continuously revving his vehicle loudly near the downtown area of the village. Due to the loud, disruptive sound of the vehicle, the officer began following the driver. The officer observed the driver crossing over the center line and abruptly changing speed. The officer then initiated her emergency lights whereupon the vehicle traveled another 500 ft before stopping.

During contact with the driver, the officer smelled a moderate odor of alcohol coming from the vehicle. The driver admitted to drinking earlier in the evening and having just left a confectionery store that had closed several hours earlier. The officer also observed that the driver had bloodshot and glossy eyes. Throughout the conversation, the suspect stumbled and had trouble pronouncing his words multiple times.

After running the suspect's information, the officer asked him to step out of the vehicle to perform field sobriety tests at the firehouse across the road from where they were stopped. During the horizontal gaze nystagmus test, the officer observed the suspect being unable to smoothly follow the stimulus. The suspect was swaying during the exercise. For the walk-and-turn test, the suspect missed contacting heel-to-toe several times, lost balance during his turn, and had his hands out to his side for balance.

During the one-legged balance test, the suspect had to be reminded to keep his hands close to his sides and failed to keep balance on the sixth second of the test. Following the field sobriety tests, the second officer asked the suspect if he would take a preliminary breath test (PBT), to which he refused. The suspect was then arrested for operating while intoxicated (OWI). While in custody, the suspect again refused to consent to a blood-alcohol content sample. Because this was the suspect's first OWI offense, he was released to his parents instead of going to the police station.
