Wisconsin Lady Charged with OWI After Denying Taking Drugs

FENNIMORE, WI - On the night of January 14th, 2020 at 10:45PM, a Fennimore Police Officer pulled over a vehicle for crossing the center line and taking a turn too close to the shoulder. The suspect told the officer she was driving the passenger's boyfriend's vehicle to get gas and cigarettes. Both the suspect and passenger struggled to find proper documentation of the truck which she claimed they were driving. While stopped, the officer observed the suspect shaking to which she replied that she was cold. The officer observed track marks on the suspect and asked her to step out of the vehicle.

When questioned, the suspect repeatedly denied taking drugs and did not know why a vein was raised that would have been indicative of drug use. The officer asked the suspect to perform field sobriety tests to which she agreed. In the horizontal gaze nystagmus test, the officer observed that the suspect was unable to follow his finger smoothly. At one point the suspect had to be told to continue following the officer's finger after she had stopped. A jerking motion in the suspect's eyes was observed at maximum deviation. During the walk-and-turn test, the suspect moved into the starting position during the instructions. Following the instructions, the officer observed that she did not remain in the starting position after having been told to do so. The suspect proceeded to take only eight steps on her first pass, failed to count out loud, and pivoted on the turn instead of taking small steps as instructed.

In the one-legged balance test, the suspect elevated higher than six inches off the ground and was observed swaying while she attempted to balance. During the lack of convergence test, the suspect again showed signs of impairment by not being able to track the officer's finger smoothly. The suspect was also unable to follow the officer's finger as he converged close to her nose. In the Romberg Test, the suspect was observed fluttering her eyes and was stopped by the officer after 80 seconds after being instructed to estimate the passage of 30 seconds. The Romberg Test was repeated and swaying was still observed.

Following the field sobriety test, the suspect denied partaking in any drugs or consuming alcohol at any point. The suspect was arrested and transported to a local hospital and consented to a chemical blood test. The suspect's blood yielded 280 ng/mL of methamphetamine and 54 ng/mL of amphetamine. The suspect was arrested and charged with operating a vehicle while under the influence (OWI, drug related).
