I just left Madrid Barajas Spanish airport (13.24pm 30Aug2022)

After the passport filter, three members of the airport health personnel have demanded my vaccination card or a PCR. When I refused, a corpulent man told me that he would hold me until I had it done and I explained to him that the only ones with the legal capacity to hold someone in my country (Spain) are the State Security Forces and Bodies (Policia Nacional or Guardia Civil). I have asked them to call an Agent of the Guardia Civil if they were holding me, since holding a person if the Agents of the State Security Forces and Bodies do not read the rights is an Illegal Detention, it is KIDNAPPG, typified by the Penal Code.

- Article 164 of the Spanish Penal Code: The kidnapping of a person demanding some condition to release him (in my case having a vaccination card or PCR), will be punished with a prison sentence of six to ten years.

- Article 163.4 of the Spanish Penal Code: The individual who, outside the cases permitted by law, apprehends a person to present him immediately to the authority, will be punished with a fine of three to six months.

- Article 163.1 of the Spanish Penal Code: The individual who locks up or detains another, depriving him of his freedom, will be punished with a prison sentence of four to six years.

They have quickly called a doctor, I have insisted that I am not going to do any damn test, and after arguments about "solidarity" in which I have not entered, obviously they have let me go without even identifying myself (because they do not have legal capacity either nor to identify myself, even for a sanction proposal), given that only the State Security Forces and Bodies (Policia Nacional or Guardia Civil) can identify someone in my country (Spain).

I've explained this before other than the passenger queue, and several have done the same; not even an Agent of the Authority can demand any medical information from you, only a null sanction proposal that you will never pay.

Whatever the Spanish Ministry of Health says, or the sheepish people who obey in queues every day at Spanish airports, it is not doing it correctly, nor legally, nor constitutionally.

THE SPANISH LAW GIVES US THE REASON.

And no; I will not generate more false PCR's. Confrontation is the price for our freedom.
