Patriots, I am sorry that I have confused the Plessy V Fergusson (1896) decision with the Scott v Sanford (1857) decision. Both are American tragedies; and in this, there is no separation of the branches of your government. The fact remains that Judge-made law is a power conferred upon no one and conferred by nothing and is supported only by custom and knavery. Using the concept of noumenon by Immanual Kant, wherein an event not witnessed is assumed to exist within the framework of a tautological argument which is deemed true by virtue of its logical form alone, using this concept one can posit the existence of agents of the British Crown budging America toward its eventual Civil War and six-hundred-thousand dead and using the Dred Scott decision, and the discord it brought, as their lever. Alito could have cited either, but, in fact, cited only Plessy.
