Post Heart Attack Treatment Complications Can Result in a Disability Approval

Heart attacks and other cardiac related medical problems can support a claim for Social Security disability benefits. But long term complications of the surgical equipment used, or on-going medications required can also be disabling.

Recently I represented a young man who had suffered a heart attack several years prior. While he continues to have some shortness of breath and chest discomfort, his inability to work arises more from nerve damage associated with catheterization equipment used during surgery.

During surgery, my client’s cardiologist used a procedure whereby an incision was made in my client’s groin, and a cutting wire was fed through an artery to clear a clot. Unfortunately, the catheterization equipment damaged nerves in my client’s groin and he has developed something called CRPS - chronic regional pain syndrome.

The CRPS causes pain, numbness, and weakness in his hips and legs, leaving him unable to walk, sit, stand, bend, kneel, stoop or crouch. He must keep his leg elevated and he experiences chronic pain.

Additionally, my client experiences ongoing chest pain and he uses sublingual nitroglycerin to address his angina. Unfortunately long term use of nitroglycerin can result in severe headaches.

So, in this case, our argument for disability was focused more on the complication from the surgery than on the actual heart attack.

Many disability judges will assume that your ability to function in a basic work environment will return within 6 months to a year following a heart attack but in cases like my client’s the aftercare and the long term complications are the real disabling factors. #heartattackandsocialsecuritydisability #crpsandcardiaccatheterization #nitroglycerinandsocialsecuritydisability
