David Marcus had already explained in 30 January 2021 that neither the conditions for incitement or for insurrection were satisfied by Trumps words or their deeds at the Capitol. So there has never been any legal basis for these absurd allegations. Even Attorney General Garland has declared that pursuing the 6 January perps is "the highest priority" of the Department of Justice. The key to the whole charade is attempting to block Trump from running again in 2024 on the ground of preemption by the 3rd Section of the 14th Amendment.
