Kshama Sawant recall appeal heads to Washington Supreme Court | Seattle Real Estate Podcast

Seattle City Councilmember Kshama Sawant's appeal to dismiss the recall effort against her will head to the Washington State Supreme Court in January 2021 where it is expected to be decided without oral arguments.

Back in September, King County Superior Judge Jim Rogers allowed four of the six charges alleged in the petition to go forward, saying in his order that the petitioner had proved "knowledge of facts indicating that the Councilmember intended to commit an unlawful act."

Sawant's team is expected to issue a reply brief on Dec. 10.

If the appeal is denied by the court, petitioners would need to collect 10,000 signatures from residents of Sawant's District 3, which represents Capitol Hill and the Central District. If enough signatures are garnered, the decision would then go on the ballot for voters to decide.

But in order to make the April ballot, all signatures would need to be submitted by late February according to SCC Insight, giving the petitioners a tight window.

The effort to recall Mayor Jenny Durkan was unanimously dismissed by the Washington Supreme Court earlier in October.
