The 12-Month Rule many people get WRONG for social security disability
In order to win Social Security disability benefits you must have a medical problem that prevents you from working and your condition must be one that has lasted or is expected to last twelve consecutive months.
As I discuss in this video, the twelve month "duration requirement" does not mean that you need to wait a year after you stop working to start the application process. You can apply for benefits the day after you stop working, as long as your medical condition is likely to last for the next year.
Even some Social Security employees are confused about the "likely to last" twelve month rules and I have had clients tell me that someone at Social Security gave them incorrect information.
Obviously Social Security will not take your word that your medical problem is likely to last twelve consecutive months - that conclusion has to come from a doctor.
So you can increase your chances at an early approval if you can get your doctor to state in writing that your medical problems will keep you out of work for at least a full year.
Even with medical support, some Social Security adjudicators are very unlikely to approve your claim if you have only been out of work for a few weeks or months when you apply.
Many deserving claims are denied, possibly in error, because the state agency adjudicators are not willing to study your medical record to look for evidence that you are likely to be unable to work for a full year.
If you are denied because of the duration requirement or for any other reason, do not give up. Make sure to file your appeal within 60 days from the date you receive your denial notice.
