The Riverside Police Department has released bodycam footage showing an officer shooting an apparently armed parolee as authorities attempted to serve an arrest warrant.
Xavier Daniel Lopez, 29, of Moreno Valley was shot once by an officer on Jan. 26 outside a home in the 4600 block of Tomlinson Avenue.
According to Officer Ryan Railsback, investigators tracked the convicted felon to the residence on Tomlinson, near Cook Avenue, where he had allegedly been staying since successfully eluding officers during a pursuit a week before.
Patrol units had tried to stop Lopez to arrest him based on a warrant connected to a 2019 vehicle theft case, on which he’d allegedly failed to appear in court. Lopez was able to speed away from his pursuers in the area of the Riverside (91) Freeway and Adams Street, according to Railsback.
In a video posted on social media Friday, Police Chief Larry Gonzalez said the bodycam video shows Lopez pulling out a gun from the inside pocket of his trench coat before he was shot by an officer.
Just before the shooting, an officer is heard on the bodycam video saying, “Hey Xavier it’s the cops. Take your hands out of your pockets, bro. Hands up, hands up.”
Two shots are fired by officers, one of which strikes Lopez in the upper body, causing him to fall to the ground.
“He’s got a gun,” an officer says in the video right after the shooting.
The video then shows officers using scissors to cut a handgun out of Lopez’s coat before rendering medical aid.
Lopez underwent surgery at Riverside Community Hospital, where he recuperated for two weeks before being booked into the Robert Presley Jail in Riverside.
Following a preliminary hearing at the Riverside Hall of Justice, Riverside County Superior Court Judge Randall Stamen found there was sufficient evidence to warrant a trial on an evading count, as well as resisting arrest, being a felon in possession of a firearm and brandishing a handgun at a peace officer.
Lopez pleaded not guilty to the charges and is scheduled to face a jury trial on May 20.
He remained jailed in lieu of $1 million bail.
According to court records, Lopez has prior convictions for receiving a stolen vehicle, assault with a gun and possession of controlled substances.
The Riverside County District Attorney’s Bureau of Investigations is leading the probe into the police shooting of Lopez.
