The Kern County Sheriff’s Office announced their Critical Incident Review Board determined the use of lethal force that resulted in the death of 36-year-old Cesar Sanchez Ruiz on Aug. 20 by Deputy Mario Garza was within departmental policy.

The Critical Incident Review Board consisted of Chief Deputy Damian Nord, Chief Deputy Larry McCurtain, and Commander Michael DeLeon, according to KCSO.

The Kern County Sheriff’s Office has identified the man killed in the shooting as 36-year-old Cesar Sanchez Ruiz.

The Kern County Sheriff’s Office says a man was killed in an officer-involved shooting outside Tony’s Firehouse Grill and Pizza on Highway 178 Thursday evening. According to KCSO, Bakersfield Police responded to Tony’s Pizza for an officer-involved shooting involving an off-duty deputy and a suspect. The suspect, a man, was killed. The deputy and restaurant goers were not hurt.

KCSO says a gun was recovered at the scene that did not belong to the deputy. Not many details have been released about what led up to the shooting at this time. The Kern County Sheriff’s Office told 17 News it has taken over the investigation from the Bakersfield Police Department because it involves their personnel. The deputy has been placed on routine paid administrative leave as part of the protocol.

Dozens of officers descended on Tony’s Firehouse Grill and Pizza on Highway 178 Thursday evening. While officials had not given a statement as of 10:30 p.m., a body was in the parking lot.

Vehicles from the Bakersfield Police Department and Kern County Sheriff’s Office at one point were in the parking lot, which was roped off with yellow crime scene tape.
