Huntsville Police Officer William Ben Darby has been convicted of murder in the shooting death of a suicidal man who was holding a gun to his own head.

A jury returned a guilty verdict on Friday. Darby was indicted in the killing of Jeffrey Parker, who was fatally shot on April 3, 2018 after calling 911 to report he was suicidal and armed.

While prosecutors contend that 27-year-old Darby killed Parker without cause, the defense argued the shooting was justified because Parker posed a threat to Darby and other officers. Defense attorney Robert Tuten told the jury that Darby had to shoot.

Darby, who was on duty on April 3, 2018 when he responded testified that he shot Parker in self defense, as well as in the defense of other officers. He said he feared Parker might shoot them.

Prosecutors argued that Darby killed Parker because he didn’t listen to his demands to drop the gun. Tim Gann, the chief trial attorney for the Madison County District, said that Darby violated his oath to serve and protect.

The verdict that was criticized by both the mayor and police chief. But it was lauded by the victim's family, who said they hope it will spur law enforcement to change how they approach mental health crises.

“We’re extremely grateful for the verdict,” said the Parkery family attorney, Martin Weinberg. “We appreciate the district attorney's office for the leadership and courage as well as the jury for their service."

Madison County Circuit Judge Donna Pate ordered Darby be taken to jail from the courtroom and set his bond at $100,000.
