2021 Mansfield police shooting incident 'justifiable use of force'

Richland County Prosecutor Gary Bishop issued a press release Friday morning detailing the finding. The incident was investigated by the Ohio Bureau of Criminal Investigation before it was forwarded to Bishop.

The prosecutor presented the case to a grand jury. Richland Source sent a public records request Friday to BCI, seeking the case file from the agency now that the investigation has been concluded.

The officer involved, patrolman Jordan Moore, resigned from the force in August before a pre-disciplinary hearing on another issue. Moore was previously suspended for 10 days after dragging a teen during another incident.

Moore was placed on paid administrative leave June 16 after the shooting incident. He chose to quit the department in August after internal investigations found he violated multiple department policies stemming from his investigations of two separate traffic accidents in May.

The pending discipline and ultimate resignation were not related to the June shooting, according to Chief Keith Porch.

Here's the statement issued by Bishop on Friday:

"The critical incident on June 16, 2021, involving former Mansfield Police Officer Jordan Moore, in which Maxwell Davis was wounded, has been determined to constitute a justifiable use of force by a Richland County Grand Jury.

"In the early evening of June 16, 2021, the Mansfield Police Department was investigating a shooting that had occurred in the area of a Johns Avenue address.

"A male had been shot at that address and was transported to the hospital for treatment. A witness provided law enforcement with a description of the shooter which was relayed to all other officers.

"Patrolman Moore was assisting in this investigation. As he was driving to the hospital to interview the shooting victim and having received a description of the shooter, he observed a person matching it, driving a vehicle near North Benton Street and West 3rd Street. Moore turned and began to follow the vehicle.

"A traffic violation was observed soon after at which point Moore attempted to initiate a traffic stop by activating his lights. The driver, later identified as Davis, did not stop his vehicle and a vehicle pursuit followed.

"Davis proceeded to flee from Moore and eventually stopped his vehicle at a residence located at 654 West 4th Street. Upon stopping the car, Davis immediately fled. Moore pursued Davis on foot, and a physical struggle followed.

"This struggle continued for a period of time, all while Moore was giving Davis commands. During the struggle, Moore recognized that Davis had a firearm.

"Davis was ordered not to grab or reach for the gun. Davis was able to break away from Moore and the patrolman drew his duty weapon. Despite commands not to do so, Davis was seen grabbing his gun and began pointing towards Moore, at which time the patrolman fired three shots.

"As the shots were fired, Davis turned to run, during which he turned and again pointed his gun at Moore. The patrolman fired three additional shots, and Davis fell to the ground.

"First aid was immediately rendered and Davis was transported to an area hospital for medical treatment."
