Malicious prosecution is the initiation of criminal proceedings despite having “no good reason to believe” that criminal charges were “justified by the facts and the law.”
Now, after the Thompson v Clark decision a citizen need not show that the criminal prosecution ended with some affirmative indication of innocence.
Such as a judgement of innocence by a judge or jury.
The citizen need only show that his or her prosecution ended without a conviction.
