The lawyers for two of the four men accused of conspiring to kidnap Michigan Gov. Gretchen Whitmer in 2020 reacted on Friday after a federal jury acquitted two men of the crime and was deadlocked on the same charges for two others.

Christopher Gibbons, attorney for Adam Fox, said there were some “serious shortcomings in the case” and that they would be ready for a new trial, while the attorney for Brandon Caserta called the jury’s decision to acquit the “best birthday present imaginable.”

The men were charged in a plot prosecutors say had been inspired by their fierce opposition to pandemic-related restrictions that her office imposed.

In a federal court in Grand Rapids, Mich., the 12-member panel found Brandon Caserta and Daniel Harris not guilty of kidnapping conspiracy charges. The jury was not able to agree on a verdict for Adam Fox and Barry Croft Jr.
