Lochner v. New York, believe it or not, has never officially been overturned, and remains one of the most controversial Supreme Court decisions of all time. The case marked a shift in how the Court began to interpret laws that regulated working conditions. After this, the Court increasingly struck down both state and federal laws that regulated labor. More broadly speaking, this case marked the beginning of a period that lasted more than three decades in which the Court generally erred more on the side of individual freedom instead of government power. In fact, historians today even call this period the “Lochner Era.” Crazy enough, the Lochner Era overlapped with the Progressive Era, a time when reformers themselves worked overtime to get rid of social and economic injustice. These reformers viewed the Lochner decision as one that simply just favored employers over employees.

Today, in the United States, impeachment basically just means charging someone in public office with a crime.
According to Article Two, Section Four of the United States Constitution:
“The President, Vice President and all Civil Officers of the United States, shall be removed from Office on Impeachment for, and Conviction of, Treason, Bribery, or other high Crimes and Misdemeanors.” It’s worth noting that “high Crimes and Misdemeanors” is uh…up for interpretation.
Oh, and while impeachment may happen at the state level, in this video we’re just going to focus on every impeachment in American history at the federal level.
According to Article One, Section Two, Clause Five of the Constitution, the U.S. House of Representatives are the only ones who have the power to impeach. First, a U.S. Representative must introduce an impeachment resolution. ANY member of the House of Representatives may do this against ANY federal public official. Not just the President, Vice President, members of the Cabinet, and other federal officials in the executive branch…but also judges and even members of Congress! The resolution is then referred to a committee- usually the House Judiciary Committee, which investigates the charges against the public official and decides whether or not to recommend ARTICLES OF IMPEACHMENT. If they do recommend it, it goes to the entire House of Representatives for a vote, baby. If a majority of the House votes in favor of ANY of the articles of impeachment, that official is impeached.

The Smiths remain one of the most prominent bands in British music history. Johnny Marr is still considered one of the greatest guitarists of all time and Morrissey is considered one of the greatest lyricists of all time.
Rarely does a band exist for such a little amount of time yet have such a huge influence. I know that “indie rock” has become a terrible, catch-all label today to describe music, but if I had to pick one band that helped make “indie rock” a thing in the first place, it would be the Smiths. Odds are, your favorite band from the past 35 years was influenced by them- that’s how influential they were. More specifically, The Smiths helped British popular music return to its rock roots, even helping create an entire genre of music- Britpop. As a matter of fact, I’d argue alternative rock wouldn’t have been nearly as big in the 1990s if it weren’t for the band.
The Smiths may have only been together a few short years, but their impact on music and culture still resonates today.

March 29, 1960
The New York Times publishes a full-page advertisement called “Heed Their Rising Voices,” which aimed to shine a spotlight on the persecution of and violence against civil rights protestors throughout the South. It specifically talks trash about the Montgomery, Alabama police force, saying that they had arrested Dr. Martin Luther King, Jr. seven times and that “truckloads” of them had stormed the Alabama State College. So uh…yeah…the ad had definitely stretched the truth. When Montgomery’s police commissioner, L.B. Sullivan, saw the ad, he was like “what the heck?!?” He viewed it as a personal attack on him and his entire police force.
Even though the ad didn’t specifically name Sullivan, he decided to write the New York Times anyway, asking the newspaper to publish a retraction of the ad. In other words, Sullivan wanted the New York Times to take it all back and admit to publishing false information. Well, the New York Times issued no such retraction. Instead, its lawyers wrote Sullivan a nice little letter that said the newspaper had no good reason to publish a retraction. Specifically, their letter said, “we…are somewhat puzzled as to how you think the statements in any way reflect on you,” adding, “you might, if you desire, let us know in what respect you claim that the statements in the advertisement reflect on you.”
Uh-huh. Sullivan didn’t like that so much, either. He sued the New York Times, saying the newspaper broke Alabama’s law for libel, a type of written defamation that hurt the reputation of someone or something. He also sued four African American ministers mentioned in the ad. After this, the New York Times did issue a retraction, but only for the Governor of Alabama, John Patterson….not Sullivan. In the Circuit Court of Montgomery County, Sullivan only had to prove that the New York Times published mistakes and that they probably hurt his reputation. The court sided with Sullivan, ordering the New York Times to award him with $500,000 in damages, which is nearly $5 million in today’s money. The New York Times appealed to the Alabama Supreme Court, but it agreed with the lower court. After this, the newspaper appealed again, this time to the SUPREME Supreme Court, who agreed to hear oral arguments in January 1964. The New York Times, of course, argued that the freedom of speech and freedom of the press parts of the First Amendment protected their right to publish that ad. It also argued that Alabama’s libel law specifically went against the First Amendment.

Johnny Cash is considered not just one of the greatest country singer-songwriters of all time, but one of the best singer-songwriters of all time…period. He’s also one of the best-selling musicians of all time, selling more than 90 million records worldwide. He performed at least 1500 songs in his career…hundreds of those songs he wrote himself. According to my calculations, he released at least 97 albums. Now you can see why I didn’t list them all.
Much of his music was about hardship, about the trials and tribulations that everyday folks go through. Despite the dark and sad themes of many of his songs, people often forget that he also knew how to be silly. Some of his biggest songs are quite lighthearted and make you smile. Thanks to his backing bands over the decades, Johnny developed an incredibly unique sound that combined multiple genres, including but not limited to country, gospel, folk, blues, rockabilly, and even rock and roll. Despite being a crossover artist, he particularly helped bring country music into the mainstream. He was, after all, a big reason why I first got into country.
There’s a reason why we often first recall those free prison concerts when we think of Johnny Cash today. That’s because his biggest appeal came from the fact that he never stopped being a champion for the downtrodden, for the forgotten in society. He was one of us.

Here in the United States we mostly have plurality voting for elections, even though most Americans agree that it’s absolutely not the best way to do elections. (turns) Wait, what’s that, you don’t remember what plurality voting is?
Plurality voting is when a citizen only gets to vote for ONE candidate, and the candidate who gets the most votes, aka a plurality, wins the election. EVEN IF THEY DON’T GET THE MAJORITY OF VOTES.

Anyway, organizations like The Center for Election Science, Fairvote, and The Equal Vote Coalition have been promoting better ways to vote for years. While all three organizations have talked trash about plurality voting, they all favor different solutions. The Center for Election Science tends to favor approval or score voting, Fairvote tends to favor ranked choice voting, and The Equal Vote Coalition is all about STAR voting.

The Gulf War was lopsided. Just 292 coalition soldiers died in this war, compared to as many as 50,000 Iraqi soldiers killed.
Most Americans were happy about the quick and decisive victory, and George H.W. Bush’s approval rating skyrocketed to around 89%, the highest approval rating for an American President recorded in history up to that point.
Many coalition soldiers came home with lingering sickness with common symptoms like chronic fatigue, fibromyalgia, and serious stomach issues. In fact, this sickness was so common it became known as “Gulf War syndrome.” Historians still debate what caused this sickness, but one recent study found a strong link to exposure to the nerve agent sarin.
There were other unintended consequences of the Gulf War.
Because the embargo against Iraq for invading Kuwait was never lifted by the United Nations after the war was over, millions of ordinary Iraqis suffered. Poverty dramatically increased in Iraq over the next several years. Not only that, after the Gulf War the Shiite in the south of Iraq and Kurds in the north of Iraq both rebelled against Saddam’s regime. Well, Saddam responded to these rebellions with extreme brutality, and this brutality led to the United States and United Kingdom continuing to patrol skies over Iraq, setting up no-fly zones, which are basically areas where aircraft are not allowed to fly and if they do they may get shot down.
After the United States accused Saddam of developing weapons of mass destruction and him refusing to let the United Nations look for them, the next President, Bill Clinton ultimately ordered Operation Desert Fox in December 1998. The American military dropped bombs on around 100 military sites around Iraq, killing or wounding as many as 1400 Iraqis.
And then, of course, the much more controversial and devastating Iraq War, which the United States started after invading Iraq again, this time without support from the United Nations. While it DID ultimately lead to the overthrow and execution of Saddam Hussein, the war, and especially the occupation of the country by American forces afterward, did not go so well, especially compared to the Gulf War. And this ultimately led to what’s simply known as the War in Iraq later on, which many people don’t realize was just as devastating.
Simply put, because of all these conflicts hundreds of thousands of civilians have died in Iraq since the Gulf War.
Even today, Iraq is not a stable place, still recovering from decades of warfare. Now, we often treat the Gulf War as a blip, a short victory overshadowed by much bigger losses later on.
In fact, while we SHOULD remember what went RIGHT during the Gulf War, we are more likely to remember what went WRONG after it.

The Vietnam War is arguably the most controversial military intervention in American history. It was objectively disastrous for everyone involved, and ever since, nearly every film about it has been at least somewhat critical of it. Even We Were Soldiers (2002), which offers a more nuanced view of the war, does well at portraying the futility of it. But while most films critical of it use drama to expose its moral quandaries (Platoon clip), one film stands out for often using humor instead (clip). Really dark humor. Here’s everything you need to know about the classic anti-war film, Full Metal Jacket.
Not only are there so many freaking war movies out there, but there’s A LOT of actually pretty good ones. Full Metal Jacket definitely stands out as a good one. Strangely, though, other Vietnam War films continue to get way more love from critics and just are more popular over all. And yet, while Full Metal Jacket seems to become increasingly overshadowed by other great war films in recent years, it has still had a long-lasting impact on how many people view not just war, but joining the military.
35 years later, we still laugh at this film…even though we might feel guilty laughing. Hartman’s rants, in particular, continue to provide countless opportunities for memes, despite being pretty offensive today. Full Metal Jacket, in fact, may be a big reason why we still accept the brutal nature of boot camp, strangely enough. There is even evidence the boot camp scenes may have even inspired more Marines to enlist. The line “Me love you long time. Me so horny.” ultimately became a catchphrase and was sampled in rap songs.
But we all still recognize that this is a serious film. Full Metal Jacket managed to not only raise awareness of the brutality of combat, but the harrowing nature of abuse recruits can endure. It doesn’t have a “happy ending.” There is not much of a resolution other than just being alive.
And while the film is technically an “anti-war” film, Kubrick never referred to it as such, and today it’s one of those rare war films that both pacifists and veterans respect. Indeed, it’s probably the best war film ever made to capture the collective doublethink we tell ourselves about war. War is evil and absurd. War is necessary and noble. It’s a constant contradiction that this scene in particular captures. (peace button clip) Simply put, no other film seems to have captured the absurdity of war quite like Full Metal Jacket.

Baltimore, Maryland
1815
John Barron owns a deep-water wharf that was among the most profitable in Baltimore Harbor. What’s that? You don’t know what a wharf is? Well, that’s perfectly understandable. I imagine most of the young folks ain’t talking about wharfs these days. A wharf is a safe area for a ship to dock and unload or load stuff.
Anyway, in 1815, Baltimore began a big renovation project to modernize the city’s infrastructure. The city began paving streets, building embankments, and diverting waterways in order to prevent flooding and stuff.
While the city was better off after these improvements, John Barron and his wharf business were not. You see, these improvements caused lots of sand to wash down into Baltimore Harbor. After seven years of this, so much sand had accumulated in the harbor that the waters around Barron’s wharf were now too shallow for most ships to dock. His business was failing.
Desperate, Barron sued the city of Baltimore to make up for his losses. He claimed the city had violated his 5th Amendment rights. Specifically, the Takings Clause of the 5th Amendment, which says that private property will not be taken for public use without “just compensation.” By the way, the government taking private property for public use is also commonly known as “eminent domain.” Anyway, Barron said the city’s destruction of his wharf fell under eminent domain, and he sued for $20,000, which is about $421,000 in today’s money. He won the case, but the Baltimore County court gave him $4,500, or $105,000 in today’s money.
Not only that, the city appealed to the Maryland Court of Appeals, and IT reversed the decision, siding with Baltimore. So Barron appealed again, but this process took years. Finally, the Supreme Court agreed to take on the case, hearing oral arguments in February 1833.
The Court had two big questions to answer. First, does the 5th Amendment prevent LOCAL governments from taking private property for public use without just compensation? And second, did the Bill of Rights AS A WHOLE apply to state and local laws, or did they only apply to federal laws, yo?

What if Abraham Lincoln didn't win the election of 1860?
Instead, let’s say Lincoln’s old debating buddy, the Illinois U.S. Senator Stephen Douglas, won the election. It’s not that wild of an idea, actually. See all those blue counties? He won those, but in A LOT of those green, yellow, and red counties, I’d argue he was the second choice. In fact, while he finished fourth in the electoral college, getting just 12 electoral votes, he finished second in the popular vote. Now, while we don’t have definitive evidence that Douglas was the second choice of a lot of voters in 1860, I can certainly infer based on that and other evidence that he would have been a lot of people’s second choice. Now I’m a big fan of ranked choice voting…if you don’t know how ranked choice voting works, I did make a video about it, which I’ve linked below. But…simply put, it’s a way to rank ALL the candidates so you don’t just have a say on ONE candidate but ALL OF THEM. With ranked choice voting, I think there’s a GOOD chance Douglas would have won. He was likely the second choice to most Breckenridge and Bell supporters.

Austin and San Antonio
Two of the biggest cities not only in Texas, but in the entire United States, and both are just 75 miles, or 121 kilometers, apart…about an hour and a half drive.
Both are also two of the fast-growing major cities in the country, and they are growing so fast that we could one day live to see them merge into each other to form a megacity.
San Antonio has the third largest metropolitan area in Texas and 24th in the country, while Austin has the fourth largest metropolitan area in Texas and 28th in the country. Austin is likely the fastest growing metro in the United States, though, and its population could catch up to San Antonio’s soon.

Before the release of his private papers in the 1970s, historians generally viewed Ike as too hands-off, as someone who’d rather play golf than run the country. However, after that suddenly historians viewed Eisenhower in a new light, and his reputation dramatically got better. Today, he is often considered not only one of the greatest generals in American history, but one of the greatest Presidents in American history.
Dwight Eisenhower is now my second favorite President in American history. The more I learn about him, the more I’m impressed. I mean, the dude freaking saved the world. In my opinion, he had all the attributes that make a great leader. Courage, integrity, humility, pragmatism, flexibility, and vision. Not only did he know how to work with all types of personalities, he actively learned from working with all types of personalities. Above all, he valued relationships, the Constitution, and American democracy. We haven’t had a leader like him since. (turn) So yeah, you bet your butt I like Ike.

I’ve always thought the House of Representatives was the part of the federal government MOST directly connected with ordinary people. After this experience, that’s not true at all.
I assumed I would get way more responses.
I do get why Representatives can’t make much time for constituents. The average Representative is supposed to represent 759,000 people. But as I said in my follow-up video to calling every Senator, I KNOW these Representatives make time for their campaign donors, and I KNOW they make time for lobbyists who bribe them. So I ask again…why can’t they make time for us?
This whole experience of calling every member of Congress has caused me to question everything about how our federal government is supposed to function. I used to naively believe that we truly lived in a constitutional republic, just like I used to teach my students in Government class. But these Representatives don’t seem to represent us much at all.
