Chad asked a great question at the Dec 21st meeting of the North Idaho College Board of Trustees. He asked what is the charter or purpose of the Board of Trustees.
From the NIC webpage:
North Idaho College is governed by a volunteer five-member board of trustees who are elected at large from within Kootenai County for staggered, four-year terms. Trustees derive their authority from and hold office in accordance with Idaho Code.
The responsibilities of the board of trustees are outlined in policy #02.01.02 of the North Idaho College Policy Manual, and include the following:
To determine the broad general policies which govern the operation of the college district.
To select and appoint the president of the college who is responsible for the general administration and implementation of board policies in the ongoing operations of the college.
To approve annual budgets.

Does North Idaho College Security Do Anything?
Before the start of the 12/10/22 Meeting of the North Idaho College Board of Trustees, NIC Security asked for a man to be escorted out of the room before the meeting due to not allowing a board member to prepare for the meeting. Security never took them out. Does NIC Security do anything? Is that not a part of their job?

Health District Director Can Over Rule/Ignore Elected Officials?

Board Attorney Marc Lyons said that county commissioners can't over rule the appointed chair of the health district board of trustees or the director of the Panhandle Health district.

At the December 2022 Meeting of the Panhandle Health District Board of Trustee Meeting, attorney Marc Lyons reviewed board responsibilities.
Lyons discusses dysfunctional boards. He tells the Panhandle Health District Trustees that it is important to not undermine the board in public. Did he give former NIC Trustees Woods and Howard that advice?
Lyons mentions that has has been legal representation for school districts, North Idaho College and other government entities. Two questions: 1) Was he the lawyer that fought for health districts mandates at the beginning of the 2020 lockdowns? and 2) When is the last time the government entities Lyons represent put out their legal representation to competitive bid?
Towards the end Lyons states that all boards should make sure their decisions take place in open in meetings. Has he been consistent in this advice?

This is an approximately 16 minute video segment of the discussion on Legal Counsel for the North Idaho College Board of Trustees during their 12/5/22 meeting.
Discussion on accepting the resignation of the former legal counsel Marc Lyons. Trustee McKenzie expressed dismay that Lyons refused to offer client attorney privilege to him or Banducci but offered it to the three appointed trustees.
NIC President Swayne says that the governor office called him and said that if a resolution is not part of the meeting packet then Idaho open meeting law was violated. McKenzie mentions that the appointed board members did the same thing and no one mentioned the law was being violated then. Swayne goes on to say that legal counsel needs an RFP. Banducci mentions that Lyons legal services didn't have an RFP.
Trustee McKenzie points out that the law states that an RFP is not required for insurance or legal counsel.
