Beware of false or misleading advertising in annuity ads, social media or in emails. Here is a problem I had to solve for a client who was subject to a misleading and false solicitation ad. Same product I showed them, only I was honest on how it work and the true interest rate and how it worked. How a 5.60% APY was presented as a 6.25% and caused me a bunch of extra work. Why couldn't this agent compete on the same level as all the rest of us is the question. The agent has to use tricks to compete. That is not ethical at all. 1 of the strongest question to ask when shopping Fixed Annuities. All Fixed Annuities will have an end of term minimum guarantee! Assumed/non-guaranteed and guaranteed accumulation value columns are on most annuity illustrations. A Multi-Year Guarantee Annuity (MYGA) will have matching values in these two columns until the end of the guarantee/surrender period. Unfortunately, not all MYGA carriers offer illustrations. The guaranteed values on a MYGA may still show a surrender charge if a 30 day exit window exists. However, those surrender charges will be waived during that window and the accumulation value will be available. After that window expires, the surrender charges will apply again and the rate will never be less than the contractual minimum guaranteed rate. Most Fixed Indexed Annuities (FIA) do have illustrations and outline the minimum guaranteed values at the end of the surrender period. The non-guaranteed accumulation values are sometimes called the hypothetical or assumed values. The strongest guarantee in any fixed annuity is the contractual minimum guarantee. These currently range for 2.00% all the way down to 0.10%. A big spread there. The hypothetical values are the sizzle and the guaranteed values are the steak! The split annuity is a way to get a guaranteed income for a set period of time that can be mostly tax excluded. In this example a $500,000 premium will guarantee: Part 1: $119,240.00 premium to an immediate annuity $2,183.09 per month of income for 60 months at up to 90% tax exclusion. Part 2: $380,760.00 premium to a Multi-Year Guarantee Deferred Annuity 5.60% guaranteed interest rate for 5 years will grow to return $500,000 Part 1 taxable: Assuming 100% cost basis (previously taxed funds) the payment may only be 10% taxable. A $2,183.09 payment with 90% exclusion ratio = $1,964.78 excluded and $218.30 taxable. At a 25% tax bracket there would be $54.57 tax on each payment. $2,128.51 would be the after tax income. Part 2 taxable: $380,760.00 is the cost basis and $119,240 is the interest gain. The interest is tax deferred until withdrawn. After the 5th year if the annuity is surrendered/cashed out the $119,240 is fully taxable as income. If 1035 exchanged to a new split annuity, the tax deferral continues. If using a partial 1035 exchange and placing funds into a new split annuity, a prorated cost basis will be used. Assuming the same rates the new cost basis on the immediate annuity side would be about $87,400 and give an exclusion ratio of about 66%.
