The evidence that was used at trial to obtain convictions in this case is crazy. How crazy? D-Day is almost here: May 31st, 2023 when the ATF Pistol Brace rule grace period ends... and the enforcement action can begin. The final deadline to use the eform website to submit your form 1s under the "amnesty" is here... but so are some other interesting options. The Firearms Policy Coalition won an injunction from the 5th Circuit Court of Appeals in the Mock v. Garland case that affirmed that the rule will not apply to FPC members... but is that ALL members? FPC seems to think so, and I believe they may be right. But there are broadly 3 classes of members: 1) People who were members of FPC when FPC filed their lawsuit 2) People who were members of FPC when the injunction was ordered 3) People who became members after both 1 and 2 above. Does the injunction cover all 3? For a $30 membership fee, should we really care? Frankly, I think everyone should join FPC and Gun Owners of America (GOA) at baseline and this is just a great perk. But the question persists. Well, there are still a few lawsuits out there, GOA v. ATF, Britto v. Garland and others. There is a chance that a judge COULD issue a similar rule in the GOA v. ATF case and as a result, at time of filming, you could STILL join GOA and become a class 2 member like above.... it's $25. The US Supreme Court on May 25, 2023 published a large case with far reaching implications for the regulation of firearms and the ATF in Sackett v. EPA (linked below). Recall that Congress passes laws, but it is up to the executive branch to enforce those laws. To aid with that there are hundreds of federal agencies and subagencies. Part of what these agencies do is that they need to interpret the laws passed by congress since it is impossible for congress to reasonable see and speak to every application of the law. Historically since a 1984 US Supreme Court case these agencies have been given broad deference to interpret these statutes provided that their interpretations are reasonable and do not contradict with the text. This doctrine is often referred to by the case that created it as the “Chevron Doctrine.” However, nearly 40 years later, we have unfortunately seen a checkered history of many federal agencies making some reasonable and some not-so-reasonable calls. The matters should then be brought to the courts, but then the courts are stuck applying the Chevron doctrine with some distasteful results. The application to firearm law is this: the principal agency responsible for regulation firearms is the ATF. They have been known to make some questionable calls… and that is a charitable description. On top of those calls, they have further been known to reverse course on themselves (Tommy builts, Akins Accelerators, FRT/WOT Triggers, Bump Stocks, Pistol Braces to name just a few). The Environmental Protection Agency informed the Sacketts that their property contained wetlands and that their backfilling violated the Clean Water Act, which prohibits discharging pollutants into “the waters of the United States.” 33 U. S. C. §1362(7). The EPA ordered the Sacketts to restore the site, threatening penalties of over $40,000 per day. The EPA classified the wetlands on the Sacketts’ lot as “waters of the United States” because they were near a ditch that fed into a creek, which fed into Priest Lake, a navigable, intrastate lake. The Sacketts sued, alleging that their property was not “waters of the United States.” The District Court entered summary judgment for the EPA. Whether the weapon has a weight or length consistent with the weight or length of similarly designed rifles; ii. Whether the weapon has a length of pull, measured from the center of the trigger to the center of the shoulder stock or other rearward accessory, component or attachment (including an adjustable or telescoping attachment with the ability to lock into various positions along a buffer tube, receiver extension, or other attachment method), that is consistent with similarly designed rifles; iii. Whether the weapon is equipped with sights or a scope with eye relief that require the weapon to be fired from the shoulder in order to be used as designed; iv. Whether the surface area that allows the weapon to be fired from the shoulder is created by a buffer tube, receiver extension, or any other accessory, component, or other rearward attachment that is necessary for the cycle of operations; v. The manufacturer’s direct and indirect marketing and promotional materials indicating the intended use of the weapon; and vi. A Federal District Court in Virginia has just struck down a portion of the 1968 Gun Control Act that prevented FFLs from selling handguns to adults under the age of 21. Gun control groups such as the Brady Campaign, the Giffords Center, and Everytown have intervened to help the federal government to defend that law: that allows and actually forces teenagers to purchase guns WITHOUT a background check. Crazy. The plaintiffs just want to have a right to a background check. The government makes several crazy arguments in their case such as the fact that while you have a right to possess a gun, you do NOT have the right to PURCHASE a firearm among others. On January 10, 2023, Illinois enacted the Protect Illinois Communities Act (PICA). PICA is a sweeping assault on the 2nd Amendment and banned around 170 common types of firearms plus other magazines and accessories. It carries with it draconian penalties that classify lawful gun owners in the same category as kidnappers and rapists. Then, a federal court judge issued a preliminary injunction pausing the application of the law. This created "Freedom Week", the unscheduled 6 day moratorium on PICA. During those 6 days, countless Illinois residents had another crack at purchasing the weapons and items protected by the 2nd Amendment but banned by the law. The injunction was lifted after 6 days by the 7th Circuit Court of Appeals. Following Freedom Week the Illinois State Police issued a statement declaring all of the items lawfully purchased to be illegal contraband. “Persons who possess a banned firearm or firearm attachment are required to endorse an affidavit by January 1, 2024, stating that any banned firearm or firearm attachments were possessed prior to the enactment of PICA (January 10, 2023) pursuant to 720 ILCS 5/24-1.9(d),” a public information officer with Illinois State Police told The Center Square in an email.
