I am going to continue the conversation from last week. The Constitution a. The Constitution sets out the boundaries of federal law. Consisting of acts of Congress, treaties ratified by the Senate, regulations promulgated by the executive branch, and case law originating from the federal judiciary. The United States Code a. The official compilation and codification of general and permanent federal statutory laws. b. So long as they are in accordance with the Constitution of the United States, federal law treaties preempt conflicting states and territorial laws in the fifty U.S. states and territories. c. Federal preemption is not universal though, it is limited. In the United States dual-sovereign system of American federalism, states are plenary sovereigns. d. Each state within the United States has their own Constitution, while, the federal government is limited to only possesses authority enumerated in the United States Constitution alone. e. State constitutions may grant broader rights to their citizens, than that of the federal constitution, as long as they don't infringe on any federal constitutional rights. The Judiciary system is a system of courts that interprits and applies the law in the name of the "state." Seperation of Powers. a. Legislation makes the laws (In a Plenary Fashion) b. Executive enforces the laws Economic Rights a. Budget of the Judiciary (Is almost completely controlled by the executive branch in developing contries) b. Proper national wealth distribution, government spending, and constitutional economics. c. corruption of the judiciary through budget planning, and various privileges, both state and private. Stare Decisis and Jurisprudence constante Plenary powers can be given to people which grant unlimited powers. a. The president can grant pardons for people, groups, corporations, and entities he choses. b. Congress has unlimited power to pass laws, levy taxes, wage wars, and arrest people. c. Congress can create charters with duplicity of its plenary powers, setting rates, and prices charged customers for energy. These prices are also exempt from review. References: The United States v.
