America celebrates Constitution Day! (It doesn't need to be rewritten; it needs to be reread)
This is Constitution Week, and Tuesday is Constitution Day, the 237th Anniversary of the signing of that document. So why do so many Americans ignore this anniversary, or are they even aware of it?
Since the Constitution did not delegate to Congress the power to create federal departments and agencies that enforce powers not delegated to the United States, all the legislation that created these agencies are unconstitutional and therefore void. Furthermore, all the legislation that appropriated monies to these agencies is also void, making their funding embezzlement.
Ladies and Gentlemen, this is only the beginning. We have before us the questions of how to enforce the limited and enumerated powers of the United States, how do we balance the federal budget, and how do we handle the powers that the federal government has illegally assumed?
Let’s face it: Depending on where you start, we’ve been ignoring the Constitution for between 100 and200 years. That means a lot of mistakes have been made, and it is a giant mess to clean up.

Lawful possession of a firearm gets man arrested
Being pulled over by law enforcement is never fun, even if you’ve done nothing wrong. Imagine you’ve been pulled over to safely deal with something in your vehicle, then have a police officer pull up behind you. Nothing to worry about, right?
Then imagine, after providing your driver's license, you’re pulled out of your car, searched, handcuffed, and “stuffed” into the back of the police cruiser while the officer searches your vehicle from stem to stern, even though you’ve done nothing wrong.
Is legally carrying a firearm probable cause that you are committing a crime? An officer of the Waterbury, CT, police department used Mr. Soukaneh’s legally possessed firearm as “probable cause” to both detain him and search his vehicle.

Can a bad case come to a good decision?
Federal limitations on gun possession have been a sticking point among the Second Amendment community for decades. I know several groups and law firms that have been looking for the perfect case to challenge these laws. Instead, Zackey Rahimi got his case to the Supreme Court first.
This case seems to be full of contradictions. On the one hand, we have §922(g)(8), which states that someone who has a court order of protection because of a finding of a credible threat to the physical safety of another cannot lawfully possess a firearm or ammunition. However, even though the subject of the order must have the opportunity to participate in a hearing before the order is issued, there is apparently no requirement that they receive due process during the hearing.

Does the Bill of Rights apply to the States?
Have you read a court opinion that said, “The Fourteenth Amendment incorporates the Bill of Rights, including the First Amendment, to the states?” By this, the court usually means that, before the Fourteenth Amendment, none of the ten amendments in the Bill of Rights could be applied to the states. However, that is a flat-out lie, and I will prove it.
Here we are, almost 200 years later, and the fiction created by the Barron court still persists today. No, the Barron court did not attempt to excise the Bill of Rights from the rest of the Constitution, but as we know, judges play a form of telephone with their opinions.
This toxic separation of the Bill of Rights and the States is a perfect example of the need for We the People to once again read and study the Constitution of our country. The only way we can be the land of the free is to be the home of people brave enough to read our founding documents, then apply them to our lives today.

SCOTUS fails the most consequential Free Speech case ever - Murthy v. Missouri
Rather than looking at the facts of the case, a majority of the justices punted, claiming that the petitioners could not show a direct causal link between the actions of those in government and social media platform censorship.
Justice Barrett, writing the opinion, makes the court’s point very succinctly. We begin—and end—with standing. At this stage, neither the individual nor the state plaintiffs have established standing to seek an injunction against any defendant. We therefore lack jurisdiction to reach the merits of the dispute.
Standing is the only thing the majority of the court even bothered considering?
The court goes on to explain that, while the plaintiffs have had their content restricted, they could show no direct causal link to government actors. The link actions taken by the social media companies could simply be coincidental to the communications with government agencies and, therefore, do not show that the injuries they suffered were caused by the federal government.

Shocking! SCOTUS found DOJ overcharged J6ers
After the January 6th riots, the U.S. Department of Justice began charging anyone they thought had participated, but not just for the crimes they committed. According to the DOJ, anyone who showed up at the Capitol had corruptly obstructed or impeded an official proceeding, which was punishable by a fine and imprisonment for up to 20 years.
Many claimed that the DOJ was overcharging these J6ers, misusing the law to punish dissenters. When it comes to 18 U. S. C. §1512(c), SCOTUS agreed.
Everyone who has been charged with a violation of §1512(c)(2) in connection with January 6th can use this opinion to move that those charges be dropped. Any other charges may proceed, after all, since they are alleged to have committed those crimes, but they do have evidence that their §1512 charges should be dropped.

The end of Chevron Deference
Chevron Deference, also called the Chevron Doctrine, comes from a 1984 Supreme Court case in which the court claimed that when Congress is silent or ambiguous in a law, the executive agency gets to “fill in the blanks.” This has allowed too much of the growth of the Administrative or Deep State. In Loper, the Supreme Court overturned Chevron, but will Loper be any better?
Chevron was a mistake from the beginning. It ignored the law in a misguided attempt to move lawmaking power into the executive branch, thus establishing what we now call the Administrative or Deep State.
Removing that power from the Administrative State can, over time, restore the executive branch to its proper role of executing laws, not establishing policy.

Breaking: “The next assassination attempt is in 30 days”
A Secret Service counter-sniper turned whistleblower has written a letter exclusively obtained by Real Clear Politics, stating the agency “should expect another assassination attempt” before November. This counter-sniper is clearly frustrated and expressed his role as a counter-sniper.

Breaking: Chaos erupts in Venezuelan capital
After Nicholas Maduro was declared the winner of Sunday’s election, he said, “No one is going to create chaos in Venezuela. I recognize and will recognize the electoral referee, the official announcements and I will make sure they are recognized."
Currently, the people of Venezuela are creating chaos in the streets. Thousands are protesting what they say was a stolen election. Supreme Court justices are turning the office of the President into a King
Before the Constitutional Convention, people expected George Washington to become our first king. Instead, we had a president, someone to execute the laws, and little else. With the decision in Trump v. United States, some are beginning to wonder, have we turned the office of president into the office of a king?
What can we conclude from this historic decision? First, we have yet another example of the court simply making up laws out of thin air. As both the opinion and the dissent noted, there is no immunity clause for the President in the Constitution, yet the court makes one up. The court claims that the separation of powers grants the President immunity, but said immunity actually contradicts the separation of power by preventing the judicial branch from doing what it is constitutionally bound to do. It appears that the court needs to take a very close look in the mirror, for it seems to be projecting itself on the dissent.

District Court discovers biology!
Every so often, you hear someone say something so true that it's a shock. In the case of Tennessee v. Cardona, Judge Reeves started his memorandum with a truth so obvious that it seemed incredible that it needed to be said. That line? “There are two sexes: male and female.”
The transgender movement boils down to a question of subjective vs objective. If someone believes they are not the “gender” they were born, is the problem with their body or their mind? This is the fundamental question and, by extension, the fundamental issue that society is being asked to decide.

Bump Stocks are back
What is a machine gun? That’s the question behind the case Garland v. Cargill. ATF promulgated a regulation redefining bump stocks as machine guns. Michael Cargill filed suit claiming the ATF violated the Administrative Procedures Act when they created the new rule. While the Supreme Court found that the rule exceeded ATF’s authority, they left open the possibility that Congress could do what the ATF could not.
This case was not about the Second Amendment. Perhaps it should be. It’s time to find representatives at all levels of government who recognize our God-given right to defend ourselves from all enemies, foreign or domestic, civilian or government. Only then would those in Congress, the Executive Branch, and the courts who want to see the American people disarmed be stopped in their tracks. Pledge to your children you'll defend their liberty
In 1776, things did not look good for the colonies. The choices before them were serious. Those 56 men who signed the Declaration of Independence knew they were committing treason against their king. Independence would cost them greatly, yet they still pledged to each other their lives, fortunes, and sacred honor. There are people today who are fighting for their independence, not from political affiliation, but from an ever-expanding and tyrannical government. This is your opportunity to declare your independence as well.
If we wish to be free of the unelected monstrosity of the “Administrative State,” we need to realize that their power is a myth because the Constitution forbids most of them from existing. To be free, we must not only know the supreme law of the land but have the fortitude to act upon it. Parents or schools ⏤ who should be protecting our children?
There has been a lot of controversy over parent’s rights lately, especially related to public schools. From the teaching of Critical Race Theory to Drag Queen Story Hours, there have been situations where the relationship between parents and the school district has become outright hostile. Since the 1932 case Meyer v. Nebraska, the Supreme Court has recognized the right of parents to direct the education of their children as being protected under the Due Process Clause of the Fourteenth Amendment.
Not only is the very idea that a school district could keep information about the health of a child away from the parents an injury to their rights, but what are the mental harms of continually lying to one’s parents?

Two court cases point to the death of justice worldwide
It’s been a bad time for justice lately. First prosecutor Karim Khan, from the International Criminal Court, sought arrest warrants for the leaders of both Hamas and Israel for war crimes. Then, barely a week later, Judge Merchan concluded his biased case against Donald Trump with biased instructions to the jury, which found Mr. Trump guilty on all 34 counts.
I think there’s a lot we can conclude from these two cases.
Trust in our institutions has been falling fast. Based on the reactions to the Trump conviction, it appears whatever faith people had is either completely gone or eroding at an astounding rate. If Mr. Khan gets his warrants, especially in the light of reports of Hamas members in UNRWA and the ongoing animosity toward Israel in many U.N. agencies, it seems that trust in the Western world may be harder to find than a unicorn.

Did Bryan Malinowski have to die?
On March 22 of this year, the Federal Bureau of Alcohol, Tobacco, and Firearms conducted a search warrant service at the home of Arkansas home of Bryan Malinowski, a high-ranking executive at the International Airport in Little Rock. There was no arrest warrant, and agents were conducting an investigation into the “gun show loophole“ that allows people to sell weapons at gun shows.
Bryan Malinowski was a gun enthusiast who had never been arrested for any crime. As part of his hobby, he would buy and sell firearms at gun shows. ATF agents broke down his front door in the darkness after putting tape over the ring doorbell. According to Mrs. Malinowski, Bryan thought he was the victim of a home invasion and opened fire at the shadows coming in his door. One of the agents was hit in the foot. They returned fire and killed Bryan Malinowski.
Serious questions are raised about the conduct and tactics used by the ATF that resulted in the death of Bryan Malinowski.

The Federal Reserve as the nation’s piggy bank
The power of the purse belongs to Congress. Article I, Section 9, Clause 7 of the Constitution states, “No Money shall be drawn from the Treasury but in Consequence of Appropriations made by Law.”This allows our representatives to keep the other branches of government in check. What would happen if an executive agency were able to get money without going through the Treasury? Why would Congress give this power away so easily?
The Appropriations Clause is pretty clear that money cannot be spent out of the Treasury without appropriations. This court, though, has somehow deemed a semi-government agency, the Federal Reserve, is the United States Treasury. Congress is not delegated the power by the Constitution to allow entities other than the Treasury to spend public money, especially for the purpose of hiding it from the American people. The Constitution, America’s tool for freedom
In the United States today, Congress passes hundreds of unconstitutional laws and the executive agencies promulgate thousands of unconstitutional rules and regulations every year, yet no one seems concerned about it. Why?
First, I believe that most politicians and bureaucrats have no clue what the Constitution actually says. I guess, in their case, ignorance is bliss.
Second, We the People rarely, if ever, actually provide the political backlash to dissuade government actors from their unconstitutional acts. Why do the American people do nothing when the supreme law of the land is violated?
The United States is a gigantic mess with hundreds of millions of people and fifty different states, all with their own agendas. You don’t have to fix the United States, though; all you have to do is make your neighborhood better.
