OPP lawyer Christopher Diana made clear the Emergency Act was not needed on day 1 of the public commission. Diana said: “While the emergencies legislation provided useful tools, there was sufficient legal authority in their absence to deal with the protest activities."

Justin Trudeau was asked if he would resign if the public commission into the Emergency Act determines it wasn't warranted. Trudeau avoided the question and falsely claimed "they" launched the inquiry for transparency. The Emergency Act invocation requires this inquiry.
