On September 15, 2023 at approximately 1:20 AM, Officer Brock Westerman with the Pullman Police Department was on patrol on NE B Street near NE California Street. As he drove northbound, he observed a 2017 Kia Sportage heading southbound that turned on to NE California Street without signaling. As he pursued the vehicle, the driver nearly struck a curb and made another turn without signaling on to NE A Street. Officer Westerman activated his emergency lights to initiate a traffic stop, and the vehicle pulled into a parking lot on the 800 block of NE A Street. He proceeded to make contact with the driver, who was identified as 19-year-old Mairead Quigley.

After he made contact with Mairead, he detected the odor of alcohol and noticed that her eyes were watery and bloodshot. He asked for her license, but she was only able to provide him with her registration. When he asked Mairead if she had been drinking, she seemed unwilling to answer questions. Based on his suspicion of impairment, Officer Westerman asked Mariead to exit the vehicle and offered her an opportunity to participate in field sobriety exercises.

Mairead was uncooperative and ultimately refused to complete any field sobriety exercises. However, he decided to place Mairead under arrest for driving under the influence based on her erratic driving and other indicators of impairment that he had observed. After she was placed in the patrol car, Officer Westerman spoke to her boyfriend and told her that she was going to be released in about 6 hours. He returned to his patrol car and transported Mairead to the Pullman Police Department for further processing.

Once they were at police HQ, Officer Westerman read Mairead her Miranda rights as well as the Implient Consent Warning, and she agreed to submit breath samples for testing. He began the 20-minute observation period, and Mairead admitted to consuming alcohol in the hours prior. After the breathalyzer was administered, her Alcotest results indicated a BAC of 0.179% (lowest IR result).

After Officer Westerman was finished with administering the breathalyzer, he placed Mairead in a cell. After a brief holding period, Mairead was removed from the cell to be photographed and fingerprinted. Afterwards, her belongings were returned to her and she was released with a summons to appear in court. Officer Westerman cited Mairead under RCW 46.61.502 for driving under the influence and released her pending a court appearance in Colfax.

Court records indicate that on October 12, 2023, Mairead pleaded guilty to driving under the influence and she was sentenced to 1 day in jail (364 days in jail with 363 days suspended) and 24 months of supervised probation. The fine was waived, but her license was suspended for 90 days and she was required to pay a DUI cost recovery fee of $67.33. She also had to comply with the terms and conditions of her probation such as attending a DUI Victim Impact Panel within 3 months and using an ignition interlock device during her license suspension.
