Old Boy's Club - Musgrave Harbour Municipal Council Reform - Newfoundland & Labrador/Beyond
If I were to try to simplify this frustration in an analogy, I would say, imagine the only way that you could communicate with someone would be via Pony Express and you can only express basic ideas like on Twitter to keep conversation going.
This message takes 2 weeks to get there and 2 weeks (if you’re lucky), to get a reply back from the Town Hall and then rinse and repeat.
Before you know it, 4 months has passed, such as happened to me.
By the time your message is received, processed, responded to and you are notified; the broken telephone game could have come in to effect and thrown everything off course, confusing the heck out of things.
Alternatively, take that same idea, and think about sometime you had sent a text message to a friend and it got out of hand due to time passing between sending it and them getting back to you.
That essentially is the downfall of the current Town Council system.
Nothing can get done that requires interaction unless everyone is enthusiastic and does not subscribe to the standard framework of old boy’s club Council meetings.
The way things work for Council meetings need to be augmented.

In 1982, the Charter was added to the Constitution, meaning that a guarantee of rights and freedoms for Canadian citizens became a part of the Supreme Law of the land. These rights and freedoms include freedom of conscience, religion, thought, belief, expression, the press, peaceful assembly, association, mobility rights, and the right to liberty and security of the person.
Some would say in this season, it could be argued that many of these rights have been breached.
Here to discuss the Charter and if, or when, it is ever granted by law to be overridden, is The Honourable Brian Peckford.
Mr. Peckford is a very accomplished Canadian political leader, and is the only remaining premier that was at the table with Prime Minister Pierre Elliott Trudeau and his government as they crafted the Canadian charter.
He’s such an important voice for such an important conversation to so many of us right now.

Town Councillor Ousted and Life Threatened for Not Getting Vaxxed!

The mayor and councillors in the town of Musgrave Harbour, Newfoundland objected to fellow councillor Grant Abbott's vaccination status which resulted in persistent and vicious attacks against Mr Abbott.
As one example, on March 12, 2022 two councillors organized a protest against Mr. Abbott, outside of his residence, because he refused to comply with the unlawful mandates.
This created backlash against Mr. Abbott in his community culminating to a gunshot through Mr. Abbott's front room window while his family, including his wife and 3 children, were sleeping.
Shortly after the protest the two councillors resigned as their actions were in violation of the Municipal Council Handbook Section 8.2 (pg 120)Values and ethics and Effective council-staff relations, and because it was just not nice.
The mayor and remaining council's actions are no less egregious, unethical and corrupt and as consequence, they must also resign to make way for an unbiased election.
Background:
In November of 2021 Mr. Grant Abbott was elected as a councillor in the Town of Musgrave Harbour, Newfoundland, with 49.16% of the eligible votes.
In December 2021, the town mandated that all councillors must receive all required doses of the Covid-19 injection by January 1st 2022.
Mr. Abbott declined the injection for not only reasons of personal-autonomy but also after researching the injection and discovering it was experimental and reported to cause severe adverse effects, including death.
As a result of Mr. Abbott's objection to injections, the mayor and other town council members arbitrarily and illegally decreed that Mr. Abbott could no longer attend public town meetings in person and forced him to attend on-line but not allow him to speak.
Mr. Abbott faithfully attended the meetings on-line, but the mayor and town council refused to allow him to participate in any discussions even though the technology allowed.
After 3 months of this abuse, all the while referring to Mr. Abbott as Councillor Abbott, and reading submitted correspondence from Mr. Abbott, the mayor and council accused Mr. Abbott of not participating in meetings, and construed a constructive dismissal against him to vacate his seat for failure of attendance.
The mayor and council are pressuring Mr. Abbott to abdicate his role as a councillor in order to call a bi-election to replace him.
The mayor and council do not have the authority to remove Mr. Abbott from his elected position by creating rules to prohibit participation.
Mr. Abbott is refusing to comply and is contesting this decision through an appeal with the Supreme Court of Canada.
Mr. Abbott has retained the help of legal counsel to pursue action against the mayor and town council in order to resume his rightful position as a town councillor.

Municipal Councilors in Small Town Newfoundland, censored from discussing public matters, publicly.
I am a municipal counselor out in Musgrave Harbour Newfoundland who had been evicted from their elected seat using collusion and targeted policies and procedures, that only I would most specifically be directly affected.
In our last council meeting, the councilors unanimously agreed to schedule a special meeting to discuss policies and procedures, but this has yet to happen.
I have found standing on a point of order in the rules of procedure for the town, as well as Roberts Rules of order. Now that it has been found, the Town Clerk claims that it was not part of the document, and that if it were, she was going to ask the councils to rescind the conditions.
Its interesting that we can consider to eliminate the exception to the rule to discuss a serios issue, but we can’t discuss the serious issue as urgently.
I have asked to see the official Rules Of Procedure least 5 times since this was said, as well as the minutes of which the words were removed.
I have yet to be acknowledge on the question or be provided with the information.
My elected seat had been vacated after my fellow counselors leveraged, and weaponized the municipalities act, using a remote attendance policy with the stipulation that one could not be unvaccinated, as a reason they could not attend Council meetings in person, and require remote attendance accommodations through, Google meet, or telephone.
On April 27th 2023, I had called a point of order on a policy that has been implemented in my absence, a policy I believe to be a direct measure taken against me and to prevent accountability and transparency.
I had provided my items to be put on the addenda, and the town was well aware and forewarned of my concerns and intentions, even as to what I would do If the meeting were called to an end.
The town had much advice and many opportunities to consider my concerns privately. They had been offered mediation by human rights, but it has been declined, as well, we have sent back and forth many settlements that did not solve any of the problems at hand.
No one wanted to talk things out, and no one wanted to say any of the fact out loud.
At the time of the meeting, The town clerk photocopied the original document, and provided it to all before the meeting beginning, so they are fully aware of my claims and should be acting on it.
It’s almost as though they think I’m going away, still.
The document was submitted before the meeting began and accepted as supporting documents for the evening.
Generally, a point of order must be raised at the time the rules are broken or else it would be too late.
For example, if a motion was made and discussion began on it, it would be too late to raise a point of order that the motion was not seconded. If such a motion was adopted without a second, it remains valid and not having a second becomes irrelevant.
Exceptions to the rule that a point of order must be raised at the time of violation include that a point of order may be raised at any time a motion was adopted in violation of the bylaws or applicable law, in conflict with a previously adopted motion (unless adopted by the vote to rescind it), or in violation of a fundamental principle of parliamentary law.
The ruling of the chair may be appealed to the assembly in most cases. A majority vote against the chair's ruling is required to overturn it.
Everything that happens in these meetings is public domain.
There is no legal pathway to prevent councilors or even attendees from recording these meetings.
As an example of this, during COVID we were told by the government to broadcast meetings when Public Health restrictions prevented attendance.
This is because it is a right for anyone who is interested to hear everything, without copyright, editing and censorship.
We as a council had agreed unanimously to get a lawyer to see if the town was permitted to enforce the policies that I called out as illegal, but this action was not taken and it was apparently assumed I wouldn't proceed legally, despite my many warnings to the contrary.
When the town did finally seek legal counsel, they were told not to proceed against me but they ignored this expert advice.
Today, not only do these illegal policies still stand; but new ones have been created, and the old ones have been strengthened and reinforced.
Since writing this, the town has taken my advice, and rescinded the Vaxpass policy, but I’m not clear on the extent of the rescind. My intention was to remove all policies as it pertains to vaccinations due to them being discriminatory as much as prohibiting people with red hair from running for politics.
Nothing the town does can supersede the law.
I wish to Motion to Rescind of entire policies for:
(1) Remote Attendance Policy
(2) Recording Policy
(3) Social Media Policy
4) Policy as pertains to councilors talking about public discussions and decisions before minutes are published a month later.

The government of Newfoundland and Labrador had a vaccination past policy in effect at the time, for about 3 months.
I had asked for a leave of absence, and the judge later had acknowledged that the Town Council had not considered my request for leave of absence, therefore voiding my due judicial process and violating my rights.
Because they did not consider my leave of absence, and combined with the vax pass and recording policy, they had created a situation that they knew full well would affect me, and only me.
I've come to find out though there is no process in place for a counselor to be reappointed, and I have been totally on my own to get reintegrated.
Reaching out to Municipal Affairs for guidance has borne unfruitful.
I have found out through the past year and a half, that Municipal Affairs is the administrative arm of the corporation of the corporation of the town.
It does not offer a counselor any advice beneficial, or useful to the counselor, except for referring to the municipalities act, the councils existing rules of procedure, and providing very, very general advice.
Specific answers such as, what would a counselor do, if they felt as though policies and procedures implemented by the Town Council are in opposition to the law of the land, such as Federal and provincial legislation.
The conversation with the director of Municipal Affairs was quite elusive.
At one point I almost lost communication with them, because they were complaining about the number of emails I was sending, all while, they are not answering my questions directly.
I've been advised through all of this and feel strongly, that small town municipalities have no overseeing body, except for the official processes in place, that could result in fines, legal action, or negative results.
So. in essence, because these small towns don't have human resources, and councilors aren't supposed to meddle in the way of office procedures, the individuals who run the office, have no boss, and do whatever they feel is appropriate with the bias of Municipal Affairs influencing the inner workings, with no regard to the individual.
The people in charge of small-town municipalities interpret things in ways that are personal to them and their experiences. They consult Municipal Affairs who do not have their best interests in mind, but rather the long-lived corporation, they are given general advice, then are left to take care of the resulting mess by themselves.
I have found that bad advice has been offered to the town many times.
So, basically, they're being puppets to the lawyers, Municipal Affairs, and the general self-lead interpretation of the municipality act, combined with the rules of procedure created by the council themselves, and any supporting legislation such as the counselors code of conduct, which has been recently implemented in Newfoundland.
If the individuals in charge of a town, which could be just one person, who runs the place, has no body invested in their well-being, and if that person advises the Council on the communications from the bodies that are interacting with them, that individual holds great power in the perception of individuals their intentions and the decisions or interpretations of the feedback from these bodies, that is a lot for one person to handle.
Councilors have no one to ask questions, no one to be the one of accountability, and no sustaining vision for the corporation and town.
Not even the mayor would know all the details, and looks to the clerk or manager for advice on facts as is seen by them and their knowledge.
The town manager knows all the rules, interprets the legislation, knows all the secrets of the trade, where all the skeletons are hidden, and holds utmost opinion of the impact of actions on those rules.
My platform for election was and is tourism, Municipal reform, transparency accountability and creating community viability through a money engine, sort of like an economic development board, to help process charitable funds through the town to create infrastructure such as a community garden, beach mats, floating ocean wheelchairs, or other community-oriented ideas. Rinse and repeat every year, and share this concept with other communities.
