Massachusetts Officially Ends Broker Fees for Renters When Landlord Hires the Agent
As of August 1, 2025, Massachusetts renters are no longer required to pay broker fees when the landlord is the one who hired the real estate agent. The new statewide law, now in effect, aims to reduce upfront costs for tenants and make housing more accessible.
Under the old system, renters were often forced to pay broker fees even when they had no say in hiring the agent—sometimes adding thousands of dollars to move-in costs. The new rule shifts that responsibility to landlords, who must now cover the broker fee if they initiate the service.
Tenant advocates and housing justice groups have long pushed for this reform, arguing the previous system was unfair and placed an undue burden on renters. The law mirrors similar regulations already in place in New York City.
While many renters are celebrating the change, real estate agents and some landlords have voiced concerns, warning it could reduce listings or lead to higher monthly rent as owners try to recoup costs.
The law does not eliminate broker fees altogether—it simply ensures that whoever hires the broker pays them. If a renter chooses to work with a broker to find a unit, they would still be responsible for that fee.
The move is being hailed as a significant step toward affordability in one of the nation’s most expensive rental markets.
