However, ICE as we know it today was formally created in March 2003 under the Homeland Security Act of 2002, a sweeping reorganization prompted by the September 11, 2001, terrorist attacks.

Its expansion reflected a post-9/11 emphasis on proactive measures against threats, including human smuggling, trafficking, and terrorism, while critics often highlighted its role in high-profile workplace raids and detention operations.Federal law empowers ICE to deport non-citizens through a robust framework anchored in the Immigration and Nationality Act (INA) of 1952, as amended, which authorizes the removal of individuals deemed inadmissible or deportable due to criminal activity, visa violations, or threats to public safety.

Key provisions like Section 287(g) of the INA, added by the Illegal Immigration Reform and Immigrant Responsibility Act of 1996, allow ICE to deputize local law enforcement for immigration enforcement, streamlining deportations of criminal aliens. Expedited removal processes further enable swift action against undocumented entrants without judicial hearings in certain cases, a tool expanded under recent executive policies to prioritize "public safety threats."
