Ada County Deputies cleared in shooting death of the man who stabbed two police K9s

The Owyhee County Prosecuting Attorney has determined that the actions of deputies and officers who shot and killed Jeremiah Gaver on January 24, 2024, were justified under Idaho law.
Chris Topmiller, the Owyhee County Prosecuting Attorney, said, "Our review included an examination of all available reports, witness statements, body-worn camera footage, and applicable legal standards, including statutory law as well as applicable Idaho Criminal Jury Instructions. Based on this comprehensive assessment, I find that the deputies’ actions in shooting Gaver were legally justified under Idaho law."
The incident began around midnight when Ada County Sheriff’s Office Deputy Colton McKone observed 37-year-old Jeremiah Gaver near the intersection of W. Amity Road and S. Cole Road in Boise. Gaver, wearing a tarp and holding an object, was seen loitering near closed businesses. Deputy McKone attempted to make contact, but Gaver was unresponsive and walked away.
Deputy McKone continued to observe Gaver, who was looking through fences into residential backyards. McKone and Deputy Michael MacLeod decided to conduct a citizen stop. Upon contact, Gaver was holding an object, later identified as a cane, and refused to identify himself. Despite multiple commands to show his hands, Gaver's right hand remained obscured under the tarp.
Additional deputies and Boise Police Department officers arrived. Deputy Jonathon Faddis, equipped with a less-lethal bean bag gun, warned Gaver he was detained, and the bean bag gun might be used if he didn’t comply. Gaver repeatedly refused commands and, after a final warning, two bean bag rounds were deployed. Deputy Jon McGee released K-9 Astrid, who was subsequently stabbed by Gaver.
Gaver shed the tarp and ran across an empty field toward a gas station. Despite commands to drop the knife, Gaver continued to flee. Multiple taser rounds were deployed but were ineffective. Gaver fell after a successful taser deployment, and Officer Connor Rush deployed K-9 Meko, who was also stabbed by Gaver.
As Gaver attempted to get to his feet while holding the knife, four deputies and one officer discharged their service weapons. Deputies attempted to render medical aid, but Gaver succumbed to his injuries at the scene.
K-9 Astrid and K-9 Meko suffered multiple stab wounds and were treated at an emergency animal hospital. Both K-9s eventually returned to service after lengthy recoveries.
