This law, known as SB 4, would give local law enforcement the power to question the immigration status of anyone they detain. Biden's administration argues that such laws are unconstitutional and create a hostile environment for immigrants in Texas. They point to the 1982 Supreme Court case Plyler v. Doe, which ruled that states cannot deny public education to undocumented children. Furthermore, the Department of Justice has filed a lawsuit against Texas, citing the Supremacy Clause of the Constitution which states that federal law takes precedence over state law in matters of immigration.
