The Clark County Educators Association (CCEA) has taken legal action in response to an injunction aimed at halting "rolling sickouts." On Thursday, they filed an appeal with the Nevada Supreme Court, challenging the injunction.

This injunction represents just one episode in the ongoing negotiations between the Clark County School District (CCSD) and CCEA regarding their contractual agreements. The day before, the court had granted the district's request to put an end to teacher "sickouts" that had led to the closure of several schools due to staff shortages.

On Thursday, CCEA submitted an emergency motion for a stay under the Nevada Rules of Appellate Procedure in response to the injunction regarding the rolling sickouts.

In their filing, CCEA contends that the injunction is fundamentally flawed due to its lack of clarity, specificity, and excessive scope. They argue that the order fails to provide any rationale for its issuance or define specific terms.

Furthermore, CCEA asserts that during the negotiations for a new collective bargaining agreement between the district and the union, there have indeed been instances of teacher absences due to illness, which occasionally resulted in school closures. However, they dispute whether the named defendants, including the union and all 18,000 public school teachers, can be held accountable for actions for which there is no evidence of responsibility. The filing points out that both CCSD and the district court have acknowledged the absence of direct evidence supporting allegations of prohibited conduct by the appellants.

As of now, there is no scheduled date for a future hearing on this case before the Nevada Supreme Court.
