Breast Implants: The Truth About Cosmetic Breast Implants

Yogis Lea Ann Carroll and Deana Sacks discuss a chapter in Deana's second book (The Godfathers of Sex Abuse, Book II: Harvey Weinstein, Bill Cosby, #MeToo, Chapter 62, pp. 217-220) that reveals that the stereotypes of women with breast implants do not match patient profiles as reported by doctors. These women are not generally exhibitionists or oversexed as per the stereotypes. Women who elect cosmetic breast implants are far more likely to be insecure with their physical appearance and therefore elect surgical breast implants in an attempt to boost self-esteem. Women with breast implants are statistically far more likely to commit suicide (and the risk increases the longer the women have breast implants), and one study showed they were 4 times more likely to die of drug or alcohol abuse. The medical risks of autoimmune and toxicity disorders are not disclosed adequately (if at all) before surgery, and the well-established-scientific fact about the psychological problems associated with breast implants is virtually never disclosed - the risk of suicide in particular.

For this reason, former law professor Deana (who taught consent as part of her torts law class) opines that the consent for breast implants is generally uninformed/under-informed/invalid. In the minority of states such as California this gives rise to a civil battery claim based on a lack of informed consent, with no injury or actual damages element necessary to prove a prima facie case. However, in most states the woman who did not fully understand the material risks or give informed consent must prove medical negligence, which requires damages and proximate cause and requires an expensive medical expert.
