Deana Sacks hosts Counterspeech with guest Emily Anderson to discuss the leaked draft opinion by Justice Alito in the pending case Dobbs v. Jackson Women's Health Organization, which threatens to reverse Roe v. Wade (1973) such that there is no federal constitutional right of abortion. The right of abortion was found to be implicit in the privacy aspect of the Liberty Clause in Roe v. Wade. Other rights such as the right of gay sexual autonomy have also been found to be implicit in the privacy aspect of the Liberty Clause (Lawrence v. Texas, 2003). If Roe v. Wade is reversed, are other rights implicit in the Liberty Clause also at risk for being dismantled? Could the constitutional right of privacy be at risk altogether?

Biden issued on April 18, 2022 that rendered the CDC's February 3, 2021 travel mask mandate unlawful and unenforceable. Mary T. Bassett et al. where the court ruled that the COVID-19 so-called "vaccine" injection mandate was "arbitrary and capricious" because the injections do not work as traditional "vaccines," i.e., they do not prevent transmission (or infection). Griess and Sacks then discuss the new FAA rule that lowers the bar for pilots to be able to fly relative to heart health. Cardiologist Thomas Levy has opined that the very high level of COVID-19 injection injuries have caused the FAA to relax standards because so many pilots are showing signs of myocarditis and other serious heart injuries after receiving COVID-19 shots - which increase the risk of a heart attack. One study out of Puerto Rico revealed that a whopping 70% of people showed signs of cardiac injury post COVID-19 vaccination. The new FAA rule puts the public (passengers on flights) at risk because pilots with heart attack risks that previously prevented them from flying are now allowed to fly under the relaxed new standard (which has been kept very quiet by the mainstream media). Griess and Sacks then discuss some ideas for assuring that medical mandates like the COVID-19 injection mandates are rejected immediately in the future, which depend on the public becoming more aware, more awake, and more willing to stand up against corrupt governments and to help themselves legally.

Ken Paxton was impeached on May 27, 2023 after many years of proceedings concerning numerous criminal indictments against Paxton as well as allegations of abuse of power. Host Deana Sacks and Clint Griess discuss Paxton's legacy of misconduct as the Texas Attorney General as well as Paxton's office's horrific treatment of women plaintiffs in civil rights cases in Texas. Sacks sued Texas Southern University after she resigned from the Thurgood Marshall School of Law in 2020 after 20 years of service. Four other female law professors including all three white females (but no males) resigned with tenure 2019-2020 following an ABA investigation that led to findings the the law school was in violation of ABA standards for gender equity. Paxton's office, in conjunction with a federal judge who did not follow the law and made numerous, egregious pretrial and trial errors, thwarted justice similar to the way that Paxton disregarded the law over in the Texas AG's office over the course of his career. Paxton settled a case brought by his employees for retaliation and abuse of power then sought for the Texas taxpayers to pay the $3.3 million settlement by seeking the Texas Legislature to approve the expenditure out of public funds. This request by Paxton for the Texas Legislature to approve paying off Paxton's liability for Paxton's misconduct triggered the investigation that led to his impeachment.

The UCC (Uniform Commercial Code) "updates" change the definition of "money" among other important changes. The legislatures in 21 states are considering adopting the new UCC provisions, and the public is largely unaware of this development. Among other things, bitcoin and cryptocurrency would not be "money" under the new definition, and could lose value. Who is behind this, and how could the new UCC provisions affect the strength of the American dollar? Just last week Kristi Noem vetoed the South Dakota legislature's decision to pass the UCC "updates," but other states are considering the changes. What is really going on? How could the new UCC provisions affect Americans?

Former professors James Fetzer and Deana Sacks discuss the Third Circuit Court of Appeals Amicus Brief that Sacks filed on 9.12.22. The NATIONS IN ACTION Amicus Brief, written by Sacks, details the Supreme Court's Liberty Clause methodology for declaring a right fundamental, which triggers a stringent constitutional test (strict scrutiny) that renders most laws unconstitutional when challenged. Lower courts have all failed to conduct a fundamental rights analysis, which has led them to apply the wrong and very deferential constitutional test (rational basis review). This is why the COVID-19 vaccine mandates have been upheld against Liberty Clause challenges - the lower courts have applied the wrong test. The Amicus Brief explains it all. The parties in interest challenge the booster mandate in New Jersey and will appeal to the Supreme Court if the Third Circuit does not apply the correct test.
