This is THE ONE: The Case We’ve Been Waiting For
Texas is suing Pennsylvania, Georgia, Michigan, and Wisconsin.
On today’s Jay Sekulow Live, we discussed the breaking news that state of Texas is suing four battleground states directly at the U.S. Supreme Court. This is a case of original jurisdiction at the high Court and could be outcome determinative on the election.
Filed by the state of Texas and its attorney general, this lawsuit is focusing on three main constitutional claims. Texas is saying that Pennsylvania, Georgia, Michigan, and Wisconsin in how they administered their elections violated the Elector’s Clause because it’s the state legislatures that have to make rules on how elections should be conducted and to implement changes if necessary. There’s an Equal Protection claim, as well as a Due Process claim.
The prayer for relief in the lawsuit is that the states cannot seat the electors and basically that the legislatures should, in each of these states, appoint new electors. So this has been filed at the U.S. Supreme Court overnight or morning by the state of Texas against Pennsylvania, Georgia, Michigan, and Wisconsin. What is key is this case could be outcome determinative. If the U.S. Supreme Court were to agree with Texas, it could ultimately be outcome determinative if the state legislatures had to pick new electors.
My dad, Jay Sekulow, discussed the significance of this case:
“What is at stake here, and this is why I think out of all the cases this is the most significant – to be clear, there’s no doubt about it – this is the most significant of the cases that has been filed. It’s the most significant because it is completely outcome determinative. What does that mean? It means that if the Court were to rule in favor of Texas, those four states, the states named in the complaint, would in in fact have their state legislatures determine the outcome. They would pick the electors.
This is a lawsuit, of course, against Georgia, Michigan, Pennsylvania, and Wisconsin. It is original jurisdiction which means it doesn’t start at the district court level. It starts at the Supreme Court of the United States where it was lodged yesterday evening very, very late; actually by the time it was lodged, probably this morning. It’s a very significant piece of litigation, in my mind, this is the one.”
This comes on the day that electors are being seated and then next week on December 14th, they will vote. So this all has to happen very quickly. This is extremely significant because the state of Texas has the jurisdiction to go right to U.S. Supreme Court, as it is a case or original jurisdiction between two or more states under the Constitution.
This is the most important lawsuit filed thus far during the legal phase of the presidential election. We’ll continue to keep you updated as it develops. At the ACLJ, we have been fighting to defend the integrity of the election and the Constitution, and if the Supreme Court takes up this case, we will look to file our own amicus brief along with our members.

This Is Only Going to Get Worse - Should America Step In?
The situation in Jerusalem may very well turn into a full-on war between Israel and Hamas, according to United Nations Middle East envoy, Tor Wennesland.
As we told you, after hundreds of rockets fired from the Gaza Strip shot into central Israel on Tuesday night, Prime Minister Benjamin Netanyahu said that Hamas and the Palestinian Islamic Jihad terror groups will “pay a heavy price” for their attacks on Israeli civilians. Over 1,050 rockets have been fired into Israel since Monday evening. In response, Israel fired 500 rockets targeting Hamas. Despite the Biden Administration calling for “de-escalation,” it is evident this situation will not be de-escalating ANY time soon.
ACLJ Senior Counsel for Global Affairs and former Secretary of State Mike Pompeo gave his read on the dangerous situation and predicted how it will play out:
"The actions to date of the terror regimes – the Hamas folks and Gaza Strips have made clear that they will stop at nothing. They are launching rockets at civilians. When I hear Democratic leaders say de-escalation or somehow that these two actors, like the Israeli and Hamas, that there is some kind of moral relativism between them that is disgusting. The United States has a responsibility, and the Trump Administration executed that responsibility that Israel has the right to defend themselves. This is a part of the larger Middle East context where the Biden Administration has consistently sided with Iran against all the other actors in the region, and this is clearly a set of missiles that Iran supported now being launched at Israel through another proxy force."
Previous Secretary of State under the Obama Administration and now the U.S. Special Presidential Envoy for Climate John Kerry has been encouraging this violence since 2016:
"Today, there are a similar number of Jews and Palestinians living between the Jordan River and the Mediterranean Sea. They have a choice. They can choose to live together in one state, or they can separate into two states. But here is a fundamental reality: if the choice is one state, Israel can either be Jewish or democratic – it cannot be both – and it won’t ever really be at peace."
These same actors are back in charge and look at what's happening.
We are watching live warfare. But let’s be clear – who started and escalated this situation? Hamas. Who is defending themselves and wants this to be over? Israel. These are unprovoked attacks by Hamas using missiles that are almost certainly coming from Iran to commit reprehensible acts of violence.
Even after knowing all of this, the Biden Administration is still weighing whether or not to unfreeze $1 billion in Iranian funds that Iran says they want to use for humanitarian relief amid the negotiations for the U.S. to reenter the Iran nuclear deal. But once they have that money they can do whatever they want with it – like providing missiles to Hamas that they can shoot into Israel.
ACLJ Chief Counsel, and my dad, Jay Sekulow summed it up best with the current situation based on the famous Winston Churchill quote, “Never has so much been surrendered (a million dollars) by so many (American taxpayer dollars) to so few (the Iranian Regime).”
The bottom line is the Biden Administration calling for “de-escalation” for the violence between Israel and Hamas is completely out of touch. Every day this situation is getting worse and worse, and our ally Israel is suffering for it. Through our office in Jerusalem, we have been able to monitor the situation and provide real-time updates. To top it all off, we have told you how the Administration is trying to restart funding to the Palestinian Authority who supports terror groups just like Hamas. Overall, this Administration has proven to be more concerned with political interests rather than America’s interests– and our enemies are noticing.

These Are the Legal Arguments - PA, WI, MI, & GA Ordered to Respond at the Supreme Court
The U.S. Supreme Court has given the four states being sued by Texas until 3 p.m. tomorrow to respond to the election lawsuit.
On today’s Jay Sekulow Live, we discussed the breaking news that the Supreme Court ordered the four states named in the suit by Texas – Georgia, Wisconsin, Pennsylvania, and Michigan – until 3 p.m. tomorrow to respond to the allegations that they violated the law and the Constitution in how they conducted the election.
They have to respond to the bill of complaint, a motion for preliminary injunction, a temporary restraining order, or alternatively, a stay that has been requested.
We also have heard from other states’ attorneys general as well about their interest in getting involved in this: Missouri, Alabama, and Louisiana. Arkansas has said they will be joining the lawsuit. And there are many other states that have expressed support and are considering how to get involved in this lawsuit.
Last night the Supreme Court of the United States issued this order:
"Response to the motion for leave to file a bill of complaint and to the motion for a preliminary injunction and temporary restraining order or, alternatively, for stay and administrative stay requested, due Thursday, December 10, by 3 pm."
My dad, Jay Sekulow, talked about the status of the case:
"So what’s happened is this, the case was filed by Ken Paxton, the Attorney General for the state of Texas. It sued Pennsylvania, Georgia, Michigan, and Wisconsin and basically asserted that because the way the elections were handled in those states, it effectively diluted the value of the electors in their state, the state of Texas.
We had two hurdles yesterday. One is you want to make sure the case gets docketed. That was something we were looking at and the case has been docketed."
ACLJ Senior Counsel Andy Ekonomou talked about the importance of the case being docketed:
"It’s been docketed, given a docketing number. For those who want to follow its docket number 220115. That means that the Court at least gave it the imprimatur of legitimacy in thinking that it was a docketable case, that it is one worthy of hearing. They turned around and ordered a briefing schedule by three o’clock tomorrow in response to be given to the allegations made by Texas."
With that 3 p.m. tomorrow deadline for a response, we could see determinative action from the U.S. Supreme Court as early as Friday. We’ll continue to monitor this for our audience and bring you our analysis as it develops.
