Summary: Designates the dissemination or promotion of misinformation or disinformation related to COVID-19 as unprofessional conduct.

[4/21/22 Update] Summary: The bill was amended in committee (on April 15) to remove the "promotion" of misinformation or disinformation related to COVID-19 as unprofessional conduct (however, it keeps that the "dissemination" of such material is unprofessional conduct). Former bill language created a procedure by which the Board could judge these situations, including whether the licensee deviated from the applicable standard of care, whether the licensee intended to mislead or acted with malicious intent, and whether the misinformation or disinformation was demonstrated to have resulted in an individual declining opportunities for treatment. The current bill language requires the Board, prior to bringing an action, to consider simply whether the misinformation or disinformation resulted in harm to patient health. Key definitions are also provided.

[6/22 Update] Amended bill omits the requirement that the Board “consider both whether the licensee departed from the applicable standard of care and whether the misinformation or disinformation resulted in harm to patient health.”

[8/22 Update] Amended bill redefines "misinformation" as false information that is contradicted by contemporary scientific consensus contrary to the standard of care.

Current Summary: Adds to the definition of unprofessional conduct the dissemination of misinformation or disinformation related to COVID-19, including "false or misleading information regarding the nature and risks of the virus, its prevention and treatment; and the development, safety, and effectiveness of COVID-19 vaccines;" and provides definitions for disinformation, misinformation, and dissemination.

The Federation of State Medical Boards’
Board of Directors released the following statement in response to a dramatic increase
in the dissemination of C-19 vaxxine misinformation and disinformation by physicians and other
health care professionals on social media platforms, online and in the media:

“Physicians who generate and spread C-19 vaxxine misinformation or disinformation are risking disciplinary action by state medical boards, including the suspension or revocation of their medical license.
Due to their specialized knowledge and training, licensed physicians possess a high degree of public trust and therefore have a powerful platform in society,
whether they recognize it or not.
They also have an ethical and professional responsibility to practice medicine in the best interests of their patients and must share information that is factual,
scientifically grounded and consensus-driven for the betterment of public health.
Spreading inaccurate C-19 vaxxine information contradicts that responsibility,
threatens to further erode public trust in the medical profession and puts all patients at risk.”
