Suspicious Man is Pulled Over and Arrested for DUI in Delray Beach

DELRAY BEACH, FL - At 4:30PM on January 4th, 2020, bystanders who call into dispatch flagged down a Delray Beach police officer who claimed that a driver and his passenger were slumped over at the wheel passed out in their vehicle. Upon awakening, the suspect drove off down the road, but the witnesses gave the officer the suspect's license plate. After relaying to dispatch, another officer found the suspect and initiated a traffic stop. The suspect stepped out of the vehicle and his identification was verified. The officers observed an empty alcoholic beverage in the car to which the suspect claimed was not recently consumed. Upon medical evaluation, the responding firefighters told the officers that the suspect's eyes were "pinpoint."

A second officer asked the suspect if he would be willing to perform a field sobriety test to which the suspect consented. During the horizontal gaze nystagmus test, the suspect was observed moving his head to track the officer's pen. Nystagmus was observed in the suspect along with a delayed reaction when tracking the object. The suspect asked how he perform to which the officer told the suspect he would tell him at the end. The suspect interrupted the officer at several points in the instructions during the walk-and-turn test. The suspect counted out loud and took nine steps forward, turned around, then walked back taking 11 steps while continuing to count to 20. The suspect demonstrated proficiency in the one-legged stand, but did not point his foot as instructed. For the finger to nose test, the suspect did not tilt his head back and hesitated when asked to place his right finger on his nose twice in a row by initially moving his left arm. The suspect also did not keep his eyes closed during the exercise. When counting from 1 to 50, the suspect did not tilt his head back and close his eyes as instructed. The suspect proceeded to count to 60 instead of 50 as instructed.

The suspect was arrested for driving under the influence (DUI) and was read his Miranda rights. The suspect asked if he could get the scores from the test to which the officer told him that there were no scores. At the station, the suspect refused to submit a breath alcohol sample.
